The Labour Party candidate for Enugu East Senatorial seat in yesterday’s elections, Sir Kelvin Chukwu, has raised alarm, accusing the Peoples Democratic Party, PDP, of plans to change the outcome of the elections by manipulating the results in Amankanu and Ugbawka and Owo in the area.

In a message sent out to the media and the public, Sir Kelvin, who replaced his brother, Barrister Oyibo Chukwu, who was assassinated days before the National Assembly elections, accused PDP of “planning to return number of figures far above number of accredited voters captured in the BVAS machines.”

He called on the chairman of the Independent National Electoral Commission, INEC, Yakubu Mahmoud, the Returning Officer, as well as the authorities “that Labour Party will not accept the truncation of the will of the people of Enugu state. We insist that all the results that will be returned from Ugbawka and Amankanu and Owo must be in accordance with number of accredited voters recorded in the BVAS machine.

Early indications are pointing to a Labour Party win in the Senatorial and Governorship elections in Enugu State amid growing concerns that the ruling PDP may have compromised electoral officials in the state.

Insiders revealed that each of the EOs were alleged to have been given $7,500 to manipulate the results to favour the PDP, regardless of the results of the elections in the state.

The National Secretary of the peoples Democratic Party (PDP), Senator Samuel Anyanwu has called on the Independent National Electoral Commission (INEC) to declare the authentic results of the state house of Assemblies election held in Imo.

Anyanwu, who made this plea on Sunday, March 19th, by the press release signed by his media assistant, Ikenna Onuoha and made available to Newsmen in Owerri.

Senator Anyanwu accused the INEC of compromising the just concluded state house of Assemblies election held yesterday, 18th March 2023, where his candidate for Ikeduru state constituency seat, Sunny Unachukwu lost to his APC opponent Johnleo Iheoha who is loyalist to Prince Charles Amadi, the operational leader of the ruling All Progressives Congress (APC) in Owerri senatorial zone.

According to him; “the INEC should release the authentic results of March 18th House of Assembly Election to reflect the realities of how Imo people voted.

“Should INEC fails to declare the authentic results to show how the people of the state voted for the peoples Democratic Party, it will be concluded that officials of the commission deliberately compromised with agents of the ruling party to subvert the mandate of the people.

Meanwhile, the All Progressives Congress APC have won over 21 constituencies out of 27 constituencies in Imo State, as officially declared by the INEC, while the Labour Party, PDP and other opposition parties are yet to win any seat.

As the Governorship & State House Assembly election commence today, Hon. Ogbaga have said there’s need for people to accommodate one another.

Chief Goddy Ogbaga, former Minister, Power & Steel, disclosed this Saturday, at Nworie Mbeke polling unit, Ebonyi LGA, Ebonyi state.

“We performed our civic duties, I cast my votes. I observed with delight that the BVAs machine worked very well. The good thing is that people were orderly. It was very peaceful, no violence. There’s need for people to show accommodation for each other, avoid violence,”he said.

Chief Cletus Ophoke, Hon. Attorney Gen. & Commissioner for Justice, who casted his vote at Nwofe primary school, polling unit 006, Izzi Local Government Area, said the area is very peaceful, calm and people are conducting themselves very orderly. Election is going on smoothly while all the BVAs machines deployed to the polling units are all working. Voters are also exercising their franchise.

Chief Frederick Nwogbaga, a stakeholder at Edufu Oferekpe 003 polling unit, Izzi LGA said the exercise is very smooth, fine, massive turn out of voters and very impressive.

Former Council Chairman, Ebonyi LGA, of Aboffia 009 polling unit, Paul Iganga, affirmed that today’s voting is better than the last election, because they started early, more organised, very friendly.

Also, Coordinator, Ebiya Development Centre, Comr. Uchenna Franklin said that they have 1,203 voters in 002 polling unit and 204 voters in 014 polling unit, making a total of 1407 voting strength from Offionwe Central school. Adding the turnout is because the people want to vote for their son, Hon. Francis Nwifuru.

Election Coverage: SERAP Wants Court To Stop Buhari, Others From Shutting Down Broadcast Stations

Socio-Economic Rights and Accountability Project (SERAP) has filed a lawsuit against President Muhammadu Buhari and the National Broadcasting Commission (NBC) for “the arbitrary use of the NBC Act and broadcasting code to sanction and threaten to revoke the licences of broadcast stations in the country and shut them down over their legitimate coverage of the 2023 general elections.”

Joined in the suit as Defendant is Mr Lai Mohammed, Minister of Information and Culture.

The NBC had last week reportedly sanctioned 25 broadcast stations and issued ‘final warnings’ to 16 others for allegedly violating provisions of the Nigeria Broadcasting Code during the February 25, 2023 Presidential and National Assembly elections.

But in the suit number FHC/L/CS/469/2023 filed last Friday at the Federal High Court, Lagos, SERAP is asking the court to determine “whether the broadcasting code used by the NBC to sanction some broadcast stations and threaten to shut down others is not in inconsistent and incompatible with freedom of expression, access to information and media freedom.”

SERAP is asking the court for “a declaration that the sanctioning of some broadcast stations and threat by the NBC to revoke the licences and shut down other stations for their lawful coverage of the general elections is unconstitutional and unlawful, as it violates freedom of expression, access to information and media freedom.”

SERAP is seeking “an order of interim injunction restraining President Buhari, the NBC and Mr Mohammed from threatening and sanctioning broadcast stations in the country simply for carrying out their constitutional duties, pending the hearing and determination of the motion on notice filed contemporaneously in this suit.”

In the suit, SERAP is arguing that: “It is a travesty of justice to punish and threaten broadcast stations seeking to promote election integrity and citizens’ engagement and participation, while allowing perpetrators of electoral violence and grave human rights violations escape accountability for their alleged crimes.”

According to SERAP, “Rather than promptly investigating allegations of election-related violence and other infractions of the Electoral Act and the Nigerian Constitution, and going after suspected perpetrators, the Nigerian government is scapegoating the media by targeting and punishing broadcast stations.”

SERAP is also arguing that, “the use of NBC Act and Code in this case would open the door to arbitrariness and fundamentally restrict freedom of expression that is an integral part of the public order protected by the Nigerian Constitution and human rights treaties to which Nigeria is a state party.”

The suit filed on behalf of SERAP by its lawyers Kolawole Oluwadare, Ms Adelanke Aremo, and Ms Valentina Adegoke, read in part: “The media plays an essential role as a vehicle or instrument for the exercise of freedom of expression and information in a democratic society.”

“The NBC legislation and codes do not confer unfettered discretion for the restriction of freedom of expression and media freedom on those charged with their implementation.”

“The sanctioning of some broadcast stations and threat by the NBC to revoke the licences of others and shut them down is neither necessary nor proportionate, as it would unduly intrude upon Nigerians’ right to freedom of expression, access to information, and media freedom.”

“The use of vague and undefined phrases such as ‘unpatriotic individuals’ ‘subversive, hateful, and inciting utterances, particularly post-election’, as grounds to sanction and threaten to broadcast stations is inconsistent and incompatible with human rights requirements.”

“The Nigerian Constitution and human rights treaties impose legal obligations on the Nigerian government to refrain from imposing restrictions which are not consistent with human rights requirements, including on discussion of political and election-related issues.”

“It is also inconsistent with constitutional and international human rights requirements to sanction and threaten broadcast stations solely for their coverage of the issues around the general elections on the basis of vague phrases such as ‘unguarded statements’, and ‘negative conversations’ used by the NBC.”

“The sanction and threat also represent a serious hindrance to the exercise of journalism, media diversity and independence, media freedom, and participation.”

“Media coverage of the general elections and post-election matters, and media freedom are closely connected, as access to information is an essential requirement for the realization of the rights to freedom of expression and participation.”

“Similarly, the phrases used by the NBC lack sufficient clarity and can be arbitrarily or discriminatorily applied and enforced.”

“The sanction, ‘last warning’ and threat by the NBC would seem not to meet the strict requirements of the Nigerian Constitution and the country’s international human rights obligations. In particular, it is unclear the scope or object of what these wordings seek to prohibit.”

“Under the constitutional and international requirement of legality, it is not enough that restrictions on freedom of expression, access to information and media freedom are formally stated in press releases and regulations.”

“The requirement of legality also serves to define the scope of legal discretion conferred on implementing authorities in order to provide adequate protection against arbitrary implementation.”

SERAP is therefore asking the court for the following reliefs:

  • A DECLARATION that the use of the NBC broadcasting code to sanction some broadcast stations and threaten to revoke the licences of others and shut them down for covering the general elections is a violation of the rights to freedom of expression, access to information and media freedom.
  • A DECLARATION that the sanction of some broadcast stations and threat to revoke the licences of others and shut them down for simply carrying out their legitimate duties of covering the general elections is a violation of the right to fair hearing as provided for under the Nigerian Constitution 1999 (as amended) and human rights treaties which Nigeria has ratified.
  • A DECLARATION that the arbitrary action by NBC to sanction some broadcast stations and threaten to revoke the licences of others and shut them down for covering the general elections is a violation of section 39 of the Nigerian Constitution 1999 [as amended], and Article 9 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act.
  • AN ORDER compelling President Buhari to direct the NBC and Mr Mohammed to withdraw the sanction and threat against broadcast stations and to comply with the provisions of section 39 of the Nigerian Constitution, and Article 9 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act.
  • AN ORDER OF PERPETUAL INJUNCTION restraining President Buhari, the NBC, and Mr Muhammed whether jointly or severally or any other authority, person or group of persons from unilaterally sanctioning and threatening to revoke the licences of any broadcast stations and shutting down the stations on the grounds of covering the 2023 general elections.

No date has been fixed for the hearing of the suit.

2023: LP, YPP Take Lead in Anambra, APGA Yet to Win Single Seat

Results emerging from different units across the various State House of Assembly Constituencies in Anambra State show that candidates of the Labour (LP) and candidates of the Young People’s Party (YPP) have taken an early lead in today’s House of Assembly election in the.

According to some yet-to-be-confirmed results, LP have so far won in about six, out of thirty state constituencies in Anambra; while YPP has so far won in three Constituency.

It was also observed in the results that the ruling All Progressive Grand Alliance (APGA) is yet to win any single constituency so far in the state.

Vote Buying: How Imo Governor Shared $500 In 4,758 Boots To Deliver APC Assembly Candidates

Vote Buying, intimidation and thuggery allegedly sponsored by the Members of the ruling All Progressives Congress (APC) in Imo State could not allow a credible poll to hold in the various Local Government Areas.

A source who did not want his name on print told our correspondent that members of the All Progressives Congress were mandated in a meeting held on Thursday with the Govenor, Hope Uzodinma at the government House in Owerri to deliver APC candidates by every necessary means.

Source revealed, that at the APC stake holders meeting held on Wednesday in preparation to the state House Of Assembly election attended by the Ward chairmen, Secretaries, commissioners, members of the expanded exco, as well as other Party stakeholders in APC where Uzodinma approved to release money for vote buying to help his party neutralize protest votes that may come from Imo people.

The source further revealed that the Govenor, had on Thursday released sum of five hundred dollars to all polling units in the state through APC state assembly candidates to deliver his party.

According to the source, “the ($500) five hundred dollars given to boot leaders would be used to buy votes, Mobilize thugs and settle security agents on election duties to enable APC rig the election.”

Meanwhile, in some local governments like Orlu Orsu, Oru East, Mbaitoli, Ikeduru, Isiala, Ehime Mbano and Mbaise. Uzodinma’s appointed sole Administrators were given unidentified armed men to intimidate members of the opposition parties from getting access to collection centers.

Bauchi state commissioner of youths and sports Alhaji Adamu Babawuro Manu Soro has refuted a video Twitter clip depicting a person alleged to have been canvassing votes for the PDP in the state prior to the Saturday governorship and house.of assembly elections in the country distributing money to women in the viral Video.

The commissioner, while refuting the report in an interview with reporters in Bauchi, expressed worry on how they named him as the person in the Twitter clip, threatening to take legal action against the medium of communication that implicated him in the report.

Our correspondent in Bauchi reports that, since Friday a Twitter clip where it mentioned that a commissioner in Bauchi was depicted buying votes for the PDP from the electorate ahead of the Saturday’s polls which clip was globally being watched on the twitter clip pages.

He said  “My name is honorable Adamu Manu Soro, commissioner for youths and sports development in Bauchi state”.

“This Twitter video clips going round globally, whoever knows Bauchi state, knows that Governor Bala Mohammed has performed creditably well in the past three and a half years in the execution of capital projects, hence it is naive for someone to allege vote buying for the ruling PDP in the state.

“I’m not the one in the said video clips going round globally, so anyone or medium of communication published a story from the video clips does so to defarming my image and refutation in the good looking eyes of the public, and by God’s grace I’ll take a legal action against that”.

Breaking News: INEC Staff Shot Dead In Rivers State, Results Not Uploaded

Information reaching 247ureports.com from Rivers State indicates that a staff of the Independent National Electoral Commission [INEC] have been shot dead.

According to the received information, the incident occurred at the Abua Central ward 7 where an INEC staff was hit by a tray bullet.

The bullets were reported to be coming from political thugs believed to be working for the Peoples Democratic Party [PDP]. The thugs were shooting to scare away voters, “so they can hijack voting materials“.

Reports indicate the victim died on the way to the hospital.

In a related development, KONO IN KHANA RIVERS STATE, ward 11 unit 9,10,11 police men numbering about 50 with their armoured vehicle led by Marvin Yobana attempted to cart away with the materials.

Breaking! Gunmen Invade Anambra Polling Units, Cart Away Election Materials, Motorcycles

There was a rambunctious scene at Ezinifite community in Nnewi South Local Government Area of Anambra, as Unknown Gunmen reportedly invaded some voting centres in the community.

The heavily-armed hoodlums were said to have invaded the area at about 2.pm, with some gunshots released into the air to announce their arrival.

According to an eyewitness who pleaded anonymity, the hoodlums came on motorcycles, while the electorates and the officials of the Independent National Electoral Commission (INEC) took to their heels, upon the hearing of their ear-splitting gunshots.

The source further revealed that the gunmen ‘scattered’ the cubicles and the tables used by the INEC officials, after which they also carted away some motorcycles belonging to the voters. The source further alleged that the hoodlums carted away some (yet-to-be-identified) election materials abandoned by the fleeing INEC officials.

Some of the centres reportedly invaded by the gunmen include Etiti 1 & 2, Umuerimanwa, and others.

It would be recalled that communities in Nnewi South Local Government Area and its environs have been major flashpoints of insecurity in Anambra State.

This notwithstanding, no single security official was also seen accompanying or guarding the INEC officials, election materials or even protecting the electorates at the various polling units in the area, as no security officials was stationed at any voting centre during the election.

Howbeit, security officials, such as the Nigerian Army, the Police, and the DSS were separately seen patrolling the area at intervals, with armoured vehicles. This was also the case during the Presidential and National Assembly Election three weeks ago in the area; but no case of security breach was reported or recorded then, unlike today’s House of Assembly election where Unknown Gunmen have reportedly manifested and registered their presence once again after a long while of calmness in the area.

EFCC Operatives Attacked, Injured By Alleged Vote Buyers in Kaduna

Operatives of the Economic and Financial Crimes Commission, EFCC, on election monitoring duty in Kaduna State today, March 18, 2023 came under attack at School Road, Unguwan Rimi Kaduna while attempting to arrest a suspected vote buyer.

The team, working on intelligence on the alleged activities of one Kabiru Musa who was seen in an amateur video allegedly inducing eligible voters by using his phone to transfer money into their accounts as they cast their votes, had mobilized to the scene to arrest the suspect.

However, immediately he was accosted by the operatives, Musa became unruly and screamed to attract the attention of his syndicate members, who descended on the operatives, using all manner of weapons that left some of them injured. It took great restraints for the operatives to ignore the unprovoked attack but insisted on arresting the suspect.

As the team drove away with the suspect, their vehicle was pelted with stones and other dangerous objects that damaged the windshield and three operatives suffered varying degrees of injuries in the process.

The injured operatives are currently receiving medical attention at the Medical Centre of the Kaduna Zonal Command, while the suspect is in custody, pending conclusion of the investigation.

It will be recalled that EFCC teams were similarly attacked during the presidential and national assembly elections, leaving some of its vehicles badly damaged.

Reacting to the incident, Executive Chairman of the Commission, Abdulrasheed Bawa commended the operatives for exercising great restraint under extreme provocation. He however appealed to the public to desist from attacking officers of the Commission as such action would no longer be tolerated.
