Nigeria Was Mistakenly Amalgamated — Anambra Lawyer, Agbasiere, Declares on 40th Birthday, Says He’s Come of Age to Question the Govt

An Anambra-based lawyer and human rights activist, Barr. Anthony Kelechi Agbasiere, has dissociated himself from the agreement on the preamble and introductory part of the 1999 Nigerian Constitution.

Recall that the preamble of the 1999 Constitution reads thus:

“We the people of the Federal Republic of Nigeria

“Having firmly and solemnly resolved to live in unity and harmony as one indivisible and indissoluble sovereign nation under God, dedicated to the promotion of inter-African solidarity, world peace, international co-operation and understanding

“And to provide for a Constitution for the purpose of promoting the good government and welfare of all persons in our country, on the principles of freedom, equality and justice, and for the purpose of consolidating the unity of our people

“Do hereby make, enact and give to ourselves the following Constitution:-”

However, speaking at his 40th birthday ceremony which held over the weekend in Awka, the Anambra State capital, Barr. Agbasiere (popularly known as Celebrity Barrister), announced the dissociation of himself from the said agreement in the preamble of the Constitution, adding he was never part of it.

According to him, he was very young when the said Constitution was created, but has now come of age to question the government and to say what he agrees to or not; hence his declaration and dissociation of himself from the said agreement in the preamble.

The legal luminary also stressed that “the country christened Nigeria was mistakenly amalgamated” in 1914, maintaining that the country is full of inequalities, while its Constitution is riddled with flaws.

Beginning with the pre-1914 amalgamation era, he went memory lane on the history of the country, state creation (most of which he said were done by military dictators from the northern region), and constitutional development, pointing out what he believes are anomalies, mistakes, flaws and unrealistic assertions he observed in them, and most of which were carried over to the present-day Nigeria, as is seen in its structures and operation.

Comparably analysing the provisions of some sections of the 1999 Nigerian Constitution and the present structural reality in the country, the celebrity lawyer declared, without mincing words, that the Southeastern geopolitical zone is being grossly marginalized. He further questioned the place of justice in Nigeria.

He further recommended referendum or the implementation of the 2014 CONFAB resolutions of the former President Goodluck Jonathan’s Administration, as part of the steps towards ending what he described as the unfair and unjust treatments being meted out to the people of the Southeastern geopolitical zone of the country, which is the only region with the lowest number of states and federal representatives.

“Sometime in 1967, Lt. Col. Yakubu Gowon created 12 states from the existing four regions. But, instead of creating 3 states from each of the 4 regions, he created 6 states from the North where he came from, and, of course, gave himself one. This was where the injustice in Nigeria started. Other military dictators who came after him also toed the same line, and today, we have 36 States and the FCT,” he said.

He, however added that, with the provision of the 1999 Constitution which says that each state shall provide 3 senators, plus the FCT (which give a total of 109), the implication is that the Northern alone that has 19 states has a total of 57 senators, while the remaining come from the the remaining regions.

This imbalance, he said, also reflects in the number of House of Representatives members from the various zones, with the Southeast having the lowest (with its five states), to the point that even the lawmakers from the Northern region alone can form a quorum and take a decision at each Chamber of the National Assembly, even without the presence, votes or opinions of the people from the Southeast.

“Where is the justice in Nigeria?” he asked

Continuing, he said, “Yes, if I’m not mistaking, one of the things that the CONFAB resolved is that there should be additional state in the southeast. It is so unjust that out of the entire 36 states or the 6 geopolitical zones, it’s only southeast that has 5, while others have more. What type of nonsense is that? It is not fair now. It is subjugation.

“So, southeast should be given sense of belonging. That’s my position on that.”

On the feasibility of referendum in addressing the perceived injustice, he said “The country is already the way it is, you understand? Referendum needs consensus. And then, for you to get that consensus, you need that of the north, you need the west, the south, and all the rest of them.

“So if you don’t get all these things, it cannot come, it cannot work. You understand? That’s the problem. So, my own is, let us follow the dictates of the constitution, even though flawed. The 1999 constitution is flawed. I have said it time and again, military dictators cannot create states for us.

“Many of the 36 states in the country were created by military dictators from the North, just to favour the North.”

Continuing, he said, “The 1999 Constitution is a product of the military, and the military is a product of coup. So, Illegality cannot beget legality. But, like I said earlier, an illegitimate child can be legitimized.

“And one of the ways you can legitimize that is by people to come together and say, Yes, we got this thing wrong, but now, let us rectify it. Let us impose some legality on it. …Mine is: If you see something wrong, you say something right. I have seen that this is wrong, and I have said that. So, let our representatives and people in the constituted authority move back and do something about that.”

While thanking God for gift of life, Barr. Agbasiere, who is also a Knight of Saint John International, philanthropist and Founder of the NGO, The Siere Foundation, also appreciated everyone who has impacted his life in one way or the other, while also restating his commitment to continue giving back to humanity and making the society a better place.

Agbasiere as an instrument God has used to resurrect many hopes, bless many families and empower many youths, especially through his philanthropic gestures and the various talent hunts, youth-oriented and empowerment-cum humanitarian programmes he has sponsored. He further wished him more blessings, wisdom, good health, and greatness on his new age, while urging him to continue being the voice to the voiceless and light through which others find their ways.

Witnessed by the mother and wife of the celebrant, Lady Mary Agbasiere and Pharm. Makuo Agbasiere respectively, the well-attended event was also graced by dignitaries and top government functionaries, as well as celebrities and entertainers from different parts of the country, who, together with the conviviality, made the ceremony remarkable and memorable, among other side attractions.

In his effort to reclaim the name of Bauchi as Mecca of Sports in Nigeria, the Bauchi State Commissioner of Youth and Sports Development Salis Mohammed Gamawa, said the ministry is working acidulously to reclaim back its name as Mecca of sports, Pearl of Tourism and hospitality.

The Commissioner made the pledged while Inaugurating three boards under the Ministry that include Bauchi State Sports Commission, Wikki Tourists fc and Bauchi State Commission for Youth and Women Rehabilitation and Development, (BACYWORD).

Gamawa, challenged newly appointed board members of parastatals under the Ministry to work in harmony and ensure progress and development of the Ministry in line with the vision and mission of the state government under the good leadership of Governor Bala Mohammed who vows to reclaim the past glory of sports in the state both in hosting and participation at National and International Competitions.

While congratulating the Chairmen and board members for their well-deserved appointment, Gamawa informed them of the importance of their responsibilities, saying that “your selection was based on merit and His Excellency the Governor expects nothing short of performance and good result stressing the need for them to work together and achieve the set goals of Bauchi becoming number one in sports activities as it used to be in the past”,.

Recall that the Commissioner had in few weeks after the state executive council meeting revealed that arrangements has been in top gear for the state government to host this year National Festival Game after 24 years.

He further disclosed that the state government through the ministry of sports have begun mobilization of partnership with national and international firms to ensure all sports facilities are readily and available before the commencement of the national event in the state.

The Commissioner, used the medium and solicit support from veteran sports men and women as well as individual to make the event a memorable one.

EFCC Arrests 13 Fake BDC Operators in Lagos

Operatives of the Lagos Zonal Command of the Economic and Financial Crimes Commission, EFCC, have arrested thirteen fake bureau de change operators in Lagos.

They were arrested for operating BDC without an appropriate licence.

The suspects are: Abdulahi Musa, Garba Abdullahi, Dauda Hussaini, Jubril Musa, Abdulwaheed Iliyasu and Abubakar Mohammed.

Others are: Umar Saidu, Nurudeen AbdulAzeez, Hamidu Usman, Yusuf Isa, Musa Ishaka, Liman Makki and Idris Mohammed.

They were arrested during sting operations by EFCC’s operatives between May 10 and 13, 2024 at different parts of Lagos, following credible intelligence received by the Commission about their illicit business activities.

Also, a suspected currency racketeer, Kafayat Lateef was also arrested over for alleged involvement in the sale of the Naira notes in different denominations.

A sum of N2,100,000.00( Two Million, One Hundred Thousand Naira) was recovered from her at the point of arrest.

The suspects will soon be charged to court as soon as investigations are concluded.

FEC Approves Initiative To Transform Nigeria’s Infrastructure And Housing Sector Through Private Partnerships

The Federal Executive Council has approved an initiative aimed at transforming the nation’s infrastructure and housing sector.

The initiative, as approved by the council, is tailored to meet the urgent demand for critical infrastructure and affordable homeownership, fostering job creation, inclusive growth, and long-term productivity enhancement.

The council gave its nod to the initiative at its meeting at the State House in Abuja on Tuesday.

The initiative will unlock private-sector funds, which Nigerians can access for 25-year mortgages at low interest rates to realize their dream of owning a home.

At a press conference after the meeting, the Minister of Finance and Coordinating Minister of the Economy, Mr. Wale Edun, explained the importance of innovative collaborations between the private sector and Sovereign Owned Enterprises (SOEs) like the Nigeria Sovereign Investment Authority (NSIA) and the Ministry of Finance Incorporated (MoFI).

He said such partnerships are envisioned to strategically channel funding to high-impact areas, ensuring impactful economic outcomes for the people.

“This alliance signifies a significant step towards driving sustainable development and economic growth in Nigeria by leveraging private-sector resources and expertise in strategic areas of need,” the Minister said.

The initiative aims to further strengthen the Federal Mortgage Bank and the Federal Housing Authority, enabling both public and private entities to fulfill their housing obligations. This collaboration is expected to boost the initial phase of the President’s Renewed Hope Cities project, with the aim of providing 50,000 units of homes across the country.

The partnership includes institutional investors creating mortgages within a framework overseen by the Ministry of Finance Incorporated to enable funding. This structure will streamline fund transfer from private investors to the housing sector, specifically the mortgage market, encouraging affordable homeownership opportunities.

The partnership will incorporate a specialized framework utilizing a special-purpose vehicle (SPV) owned by the Nigeria Sovereign Investment Authority. This structure will enable institutional investors to provide sustainable long-term financing with robust oversight, reducing risks associated with large-scale government projects.

The initiative also aims to ensure private-sector involvement in project governance, cost management, and asset delivery, offering tangible benefits to Nigerians while safeguarding investor interests. The infrastructure focus includes power generation, toll roads, and railway projects to align with the government’s economic goals.

Simultaneously, the federal government of Nigeria will concentrate on funding essential infrastructure to enhance project viability for private-sector participation.

Private-sector discussions and commitments indicate a potential mobilization of around N2 trillion in long-term financing for housing and infrastructure projects nationwide. This partnership holds the promise of numerous benefits for the Nigerian population.

By collaborating with private institutional investors, the President Tinubu-led government seeks to leverage the expertise and capital of private investors to accelerate the delivery of vital projects, driving sustainable development and economic progress for all Nigerians.

EFCC Arraigns Two for N12.9m Fraud in Maiduguri

The Maiduguri Zonal Command of the Economic and Financial Crimes Commission, EFCC, on Monday, May 13, 2024, arraigned Babakura Muhammad Nur and Kaltum Mustapha for criminal misappropriation to the tune of N12,950,000( Twelve Million, Nine Hundred and Fifty Thousand Naira only)

The duos were arraigned separately before Justice Aisha Kumaliya of the Borno State High Court on one -count charge for criminal misappropriation and cheating.

The count against Nur reads: “That you Baba Kura Muhammad Nur, on or about September, 2021 in Maiduguri, Borno State within the jurisdiction of this Honourable Court dishonestly misappropriated and converted for your own use the sum of N11, 600,000.00 (Eleven Million, Six Hundred Thousand Naira) being payment for foodstuffs belonging to Alhaji Usman Mohammed and you thereby committed an offence contrary to and punishable under Sections 308 and 309 of the Penal Code Laws Borno State (Cap 102Vol. 3 of 1994)respectively.”

While the charge against Mustapha reads: “That you Kaltum Mustapha, sometime in June, 2022 at Maiduguri, within the jurisdiction of this Honourable Court, dishonestly induced the duos of Muhammad Lawan Sani Abubakar Umar and Yusuf Jafar to deliver to you the sum of N1,350,000.00 ) only for the supply of ready to use Threropeutic RUTH (a.k.a Tammua packages)which you are yet to pay and thereby committed an offence contrary to Section 320(a) and punishable under Section 322 of the penal Code cap 102 Laws of Borno State.”

The defendants pleaded “not guilty” to their separate charges when they were read to them.

Counsel for the prosecution, Mukhtar Ali Ahmad, S.O Saka and A.D Aliyu prayed the court for trial dates and to remand the defendants in prison custody.

Justice Kumaliya thereafter admitted Mustapha to bail in the sum of N2million and two sureties in like sum. The Judge ordered that one of the sureties must be her husband and the other a staff of Borno State Civil Service not below level 10

Justice Kumaliya adjourned the matters till May 27, 28 & 29, 2024 for commencement of trial and remanded Nur in the Correctional Centre.

President Bola Tinubu has received the report of the High Powered Presidential Committee (HPPC) on Nigeria’s Extended Continental Shelf Project with a commendation to the team of experts who worked hard over the years to advance the project, which aims to extend Nigeria’s maritime boundaries in accordance with the United Nations Convention on the Law of the Sea (UNCLOS), 1982.

The President expressed his appreciation on Tuesday in Abuja after listening to technical presentations by Professor Larry Awosika, a marine scientist and member of the Committee, and Surveyor Aliyu Omar, Secretary of the HPPC.

The experts have been involved in the project since Nigeria’s initial submission to extend its continental shelf to the United Nations Commission on the Limits of the Continental Shelf (CLCS) in 2009.

They informed the President that the UN has approved Nigeria’s submission, granting sovereignty over additional square kilometres of maritime territory.

”When the HPPC briefed former President Muhammadu Buhari in 2022 on the status of the project, the United Nations Commission on the Limits of the Continental Shelf (CLCS) was still considering Nigeria’s submission and having technical interactions with the HPPC.

”These interactions and consideration have now culminated in the approval for Nigeria to extend its continental shelf beyond 200M (200 nautical miles).

”As it stands now, the area approved for Nigeria is about 16,300 square kilometres, which is about five times the size of Lagos State,’’ Surveyor Omar told the President.

He added that the official notification of the decision was conveyed to Nigeria by the UN Nations Commission on the Limits of the Continental Shelf (CLCS) in August 2023, shortly after President Tinubu assumed office.

Omar outlined the available options for Nigeria following the approval:

”The first option is to take the area gained and finalize the registration with the UN Secretary-General and close everything, meaning that we are satisfied with what we got. This will take at least one year.

”The second option is to take what we have right now, acquire more data, do a support write-up, and make a revised submission as recommended by CLCS for further consideration. This will take another four years.

”Either way (options), Nigeria will keep what has been approved.’’

In his presentation, Professor Awosika explained that the approval came after years of meticulous scientific research on geophysics, geology, geography, and diplomatic efforts, which solidified Nigeria’s legal rights over a vast expanse of seabed and subsoil beyond its traditional territorial waters.

Awosika highlighted the economic potential of the newly acquired territory, which includes hydrocarbons, gas, solid minerals, and a wide variety of sedentary species.

He, however, cautioned against total disclosure of sensitive data acquired during surveys, noting that this will jeopardize confidentiality as Nigeria is expected to monetize the information to recover project expenses.

Responding, the President thanked the experts for their diligence, emphasizing the significance of the achievement for Nigeria’s economic and strategic interests.

‘‘This is big congratulations for Nigeria,’’ he said while recounting how former President Buhari had briefed him on the importance of the project.

”At COP28 in Dubai, I also exchanged views with President Lula of Brazil on the need for collaboration within our economic and maritime boundaries.

”Today, it is a great honour for me to receive this report. I have listened attentively to this very specialized report, and I know it took a whole lot of effort to get to this stage.

”I commend the team, and we must take advantage of this and invite you again to have a repeat of this knowledge exploration on geography, hydrography, and the marine life.

”Nigeria is grateful for the efforts that you put into gaining additional territory for the country without going to war. Some nations went to war, lost people and economic opportunities.

”We lost nothing but have gained great benefits for Nigeria. We will pursue the best option for the country,” the President said.

Ambassador Hassan Tukur, Chairman of the HPPC; Chief of Staff to the President, Honourable Femi Gbajabiamila, and the Minister of Marine and Blue Economy, Adegboyega Oyetola, also attended the meeting.

Alleged N178m Land Fraud: Witness Narrates how UniJos Union Leaders Defrauded Members

The Fourth Prosecution Witness , PW4, Bitrus Sambo Bako in the trial of Kassam Kopte and Yakubu Zwalnan, former Chairman and Secretary of the University of Jos Non-Academic Staff Union of Education and Associated Institutions respectively on Tuesday, May 14, 2024 narrated before Justice S.P. Gang of the Plateau State High Court, Jos how the defendants lured union members into fraudulent land deals and defrauded them of their life savings.

The duo are facing trial by the Economic and Financial Crimes Commission, EFCC, on three-count charges that border on criminal breach of trust and conspiracy to defraud to the tune of N178,583,560.36 (One Hundred and Seventy-eight Million, Five Hundred and Eighty-three Thousand, Five Hundred and Sixty Naira, Thirty-six Kobo) in contravention of Section 97 of the Penal Code Laws of Plateau State and punishable under the same law.

Led in evidence by prosecution counsel, Steve Odiase, the witness stated that he knew the defendants and had dealings with them during their tenure as union executives. Kopte he said, was UniJos NASU President from 2012 to 2019, while Zwalnan was the Secretary.

According to him, “I paid for one plot of land with the sum of N170,000 (One Hundred and Seventy Thousand Naira), and an additional N4,500 for processing the land papers, but I never received the documents or took possession of the land.”

The witness further disclosed that the defendants advertised for the sale of the plots of land in two locations-Jos South and Jos East-to the University of Jos community.

He recognized the photocopy of the document with which the ownership of the land was processed for him which was admitted in court as ‘Exhibit E2’ after opposition from counsel to the first defendant, D.G Dashe and that of the second defendant.

Justice Gang thereafter adjourned the matter till July 15, 2024, for continuation of trial.

SMEs: Gov. Yusuf flags-off Monthly women empowerment in Kano

……. Over five thousand beneficiaries set to recieve N50,000 monthly

Governor Abba Kabir Yusuf of Kano State has initiated a monthly empowerment program providing N50,000 to 5,200 women in the state.

This was contained in a statement issued by governor spokesperson Sunusi Bature Dawakin Tofa on Tuesday.

Addressing the audience during the launch of the initiative at the Government House in Kano on Tuesday, the governor announced that each of the 5,200 women spread across the 44 Local Government areas of the state would receive the cash, totaling N260 million, every month until the conclusion of his tenure.

Governor Yusuf described the grant as a starting point for the recipients to establish small-scale enterprises, thereby improving their economic standing in light of the familial responsibilities they bear.

He elucidated that the program, managed by the Community Re-orientation Committee (CRC), entails assisting 100 women from each of the 36 rural Local Governments and 200 women from each of the 8 metropolitan LGAs.

The governor also proclaimed that this assistance serves as a gesture of gratitude to the women for their overwhelming backing during the 2023 elections.

“This is a token of appreciation for your support and dedication during the 2023 election campaign.

“We made a commitment to assist you in taking care of yourselves and your families. We vowed to help you become self-sufficient and ensure the well-being of your health, particularly for pregnant women and children among you.

“Today, we have honored our pledge. We will continue to provide this support to the same number of women every month until the end of our administration.

“The funds are intended to be utilized as seed money for small-scale businesses such as awara, gireba, koko da kosai, local juices, kuli-kuli, and more.

“Furthermore, as part of our commitment to support you, we have refurbished and enhanced hospitals, especially maternity and pediatric units, and we are in the process of upgrading others throughout the state, all aimed at alleviating your hardships and empowering you,” Governor Yusuf stated.

The governor urged the beneficiaries to utilize the grant and cautioned that any official found attempting to defraud the women would face consequences.

The empowerment programme will be sustained for the next 36 month throughout the first tenure of Governor Abba Kabir Yusuf where over two hudred thousand women will benefit from the initiative.

EFCC Arrests Two in Kaduna for Counterfeiting $81,700

Operatives of the Kaduna Zonal Command of the Economic and Financial Crimes Commission, EFCC, have arrested the duo of Abdullahi Yahaya and Ibrahim Haruna in Kaduna metropolis for their suspected involvement in currency counterfeiting.

 Upon arrest, a total sum of $81,700 (Eighty-one Thousand, Seven Hundred Dollars), all in fake $100 denomination, was found in their possession.

Haruna, upon interrogation claimed that the counterfeit dollars were delivered to him some months back for safe-keeping by one Babangida said to be at large.

Yahaya on his part claimed that he got to know that Haruna possessed fake dollars when one Kabiru, also said to be at large, connected him to Haruna for the purpose of collecting the fake dollars for delivery to a buyer who was waiting at an agreed location.

Other items found in their possession as at the time of arrest included a small quantity of colourless substance, suspected to be mercury, a chemical allegedly being used to aid the production of fake dollars.

The suspects will be charged to court as soon as investigations are concluded.
