Court Adjourns Till May 4 For Adoption of Final Written Addresses in First Nation MD, Kayode Odukoya’s Alleged N1.7bn Fraud

Justice Mojisola Dada of the Special Offences Court sitting in Ikeja, Lagos, on Wednesday, March 8, 2023, further adjourned till Thursday, May 4, 2023 for the adoption of final written addresses in relation to the alleged N1.7 billion fraud case involving the Chief Executive Officer of First Nation Airways Limited, Kayode Odukoya.

The Economic and Financial Crimes Commission, EFCC, is prosecuting Odukoya alongside First Nation Airways Limited and Belleview Airlines Limited on a seven-count charge bordering on forgery, use of false document, perjury, stealing and obtaining credit by fraud, contrary to Section 85(1), 86(1), 278(1)&(b), 285(1), 313(1)(a) &(b), 361(1)(a)& (b), 363 (1) and 364(1) of the Criminal Law of Lagos State of Nigeria 2011.

One of the counts reads: “Kayode Odukoya and First Nation Airways, on or about the 29th day of August, 2013 in Lagos, within the lkeja Judicial Division, by means of fraud, obtained the credit of N307,268,406.43 for yourselves from Skye Bank Plc (Now Polaris Bank Ltd) and made the bank to incur liability by presenting a Memorandum of Loss at Lagos State Certificate of Occupancy registered as No.33 at page 33 in Volume 1011 at the Lagos State Registry, Alausa, Ikeja in respect of property being and situate at No. 29 Oduduwa Street, lkeja GRA. Lagos State.”

Another count reads: “Kayode Odukoya, First Nation Airways Limited and Bellview Airlines Limited, on or about the 7th day of October, 2016 in Lagos, within the Lagos Judicial Division, dishonestly converted to your own use the sum of N1, 742,994,962.04 (One Billion, Seven Hundred and Forty-one Million, Nine Hundred and Ninety-four Thousand, Nine Hundred and Sixty-two Naira, Four Kobo) property of Skye Bank Plc.”

He pleaded “not guilty” to the charges, thereby prompting the commencement of trial.

The prosecution, before closing its case on November 30, 2020, had called five witnesses and tendered several documents to prove the case against the defendants.

However, the defendant, through his counsel, E.D. Onyeke, had applied for a no-case submission, which was subsequently dismissed by the trial judge on January 11, 2022, as he was ordered to open his defence.

The defendant, thereafter, took to the dock to defend himself.

Following the conclusion of his defence, Justice Dada, on November 9, 2022, adjourned the matter till March 8, 2023 for the adoption of final written addresses.

At today’s proceedings, Onyeke informed the court that there was a delay in filing the final written address for the defence.

“My lord, I must apologise, as there was a delay on our part in filing the final written address of the defence,” he said.

He further noted that the prosecution would need time to reply.

According to him, an affidavit of facts was filed by the defence, which he said also contributed to the delay.

“Count three is no longer in the charges, as it was dismissed at the Court of Appeal; so, we didn’t respond to it,” he added.

Responding, the prosecuting counsel, Nnaemeka Omewa, confirmed late receipt of the final written address.

“The final written address was served on the prosecution on the 3rd of March 2023.

“It is a 54-page document and obviously we will need adequate time to respond,” he said.

Justice Dada adjourned till Thursday, May 4, 2023 for the adoption of final written addresses.

Six killed including a pregnant woman as bandits launch another attack in Niger

No fewer than six people including a pregnant woman were reportedly killed when terrorists suspected to be members of the Islamic State’s West Africa Province (ISWAP) attacked, and open fire on a certain community in Niger State.

According to reports, the terrorists carried out the inhumane attack which claimed the lives of the pregnant woman and five others yet-to-be-identified persons on Tuesday night, March 7, 2023.

No fewer than fifty people were reportedly kidnapped by the assailants who operated around the Anawanka, Sabon Gari, and Kundu axis of the two local government areas late at night yesterday.

It was also learnt that a Nigeria Air Force (NAF) fighter jet engaged the bandits for several hours, but the detail of the operation or otherwise was not yet known.

The State Commissioner for Internal Security and Humanitarian Affairs, Emmanuel Umar, has confirmed the incident to newsmen but was yet to ascertain the details of the attack.

APC named presidential election petition legal team

Former Chairman of the Nigerian Bar Association, NBA, Idemili branch in Anambra state, Hon. Samuel Chukwukelu has expressed disappointment over what he described as the brazen manner with which the electoral umpire, Independent National Electoral Commission, INEC manipulated the recently concluded presidential election in the country.

He therefore offered a free legal service to the aggrieved Labour Party executive and its presidential candidate, Peter Obi to enable them recover their stolen mandate from the All Progressives Congress, APC and its flag bearer, Ahmed Bola Tinubu so as to serve as a deterrent to other contestants in future elections.

Speaking to newsmen yesterday at his law chamber in Nkpor, near Onitsha, Chukwukelu said the volume of manipulation allegedly perpetrated by INEC in favour of APC was too inexplicable that somebody like himself and other lovers of democracy should intervene and join hands with the supposed winners of the election to recover their mandate if democracy must survive in Nigeria.

According to Chukwukelu, a private legal practitioner, “The election generally was marred with irregularities, non compliance with relevant sections of the Electoral Act and violence in some areas and as a result, the exercise amounts to nullity”.

“We are therefore calling on INEC to annul or cancel the result in respect of post or position of president. The law is meant to be obeyed and has to be obeyed, otherwise there wouldn’t have been any need for such laws to be made ab initio”.

” Every law made is meant to address certain situations and if that which the law is meant to be addressed is not followed in accordance, that thing will not be deemed or be said to have been done at all, having failed to do it in accordance with the way and manner that law was made”.

“In the instant case, therefore, the laws that regulate the conduct of election in Nigeria is the Electoral Act. 2022 and this Act specifically stated the procedure to be followed in conducting elections vis-à-vis the presidential election and the Act provides that all the elections will be conducted in various polling units and it started by stating what the Electoral Officers in the polling units ought to do by carrying out accreditation exercise”.

“The law says that upon accreditation, the electoral officers will be able to know the numbers of voters in a polling unit. To make it easier, the Act introduced BIVAS in which case, the accreditation is no longer done manually. Every voter is captured in the process of accreditation, then upon conclusion of the voting exercise, the votes are counted at the polling units and results announced in the units and same results captured and sent directly to the server so that there wouldn’t be any room for manipulations “.

“The introduction of BIVAS in the present Electoral Act is the highest achievement made by the country in our electoral system because it reduced the opportunity of fraudsters and or election riggers in Nigeria and it is this mischief which the Electoral law tends to arrest that the INEC deliberately ignored and went ahead to embark on manual collation of results, suspending the usage of the newly introduced BIVAS”.

“The question now is what is the effects of the exercise and it amounts to nullity as they could not conduct the election in line with the electoral act. You don’t choose when to obey the law and when not to obey. INEC has no right to do so. They can’t just comply with the law in respect to the Senate and House of Representatives elections and decide otherwise in presidential election that was done same time. It is unjustifiable and cannot be supported”.

” INEC has disappointed us at a time we are waking up from slumber. The electoral law raised hope for Nigerians but unfortunately, the hope to see a new Nigeria by Nigerians was killed by INEC. As you can see, there was no jubilation anywhere when that result was announced in favour of Tinubu. Everybody went into mourning mood “.

Yakubu Mahmoud should be removed from that seat because he is not worthy to hold that office again. He is a disgrace to Nigeria and to his family and he will forever be remembered for that in the history of Nigeria. His removal from office does not exonerate him from punishment, having committed a punishable offence. Rigging an election is an offence punishable by law. The offence has been committed and time does not give waiver for the punishment”.

On the new naira swap policy, Chukwukelu queried: ” what have they achieved in the so-called naira swap? Nothing. The swap policy was based on checkmating rigging and vote buying . Federal Government achieved that as people voted willingly according to their conscience only for their votes not to count. That is the height of man’s inhumanity to man and posterity will live to judge them for ignoring the law and imposing the candidate of APC, Tinubu as the president- elect of Nigeria which obviously will affect them in future elections as aparthy will now be enthroned “.

“Definitely, the court is the last hope of a common man and we still believe so. If President Muhammadu Buhari fails to compel the umpire to cancel this election, then we should continue to be law abiding and allow those aggrieved to go to court and that is why I decided to offer free legal services to the presumed winners of the recently concluded presidential election”.

Atiku vows to challenge Tinubu’s victory with 19 SANs

PRESIDENTIAL candidate of the Peoples Democratic Party (PDP), Atiku Abubakar, has formed a 19 legal luminaries whom are all ( SAN’s) to challenge the victory of Bola Tinubu in the February 25 presidential election.

The PDP presidential candidate, while inaugurating the legal team at his campaign headquarters in Abuja, charged it to establish the claim of illegality in the February 25 presidential election and reclaim the mandate of the Nigerian people.

Atiku told the team that apart from reclaiming the mandate from those who undertook the electoral heist that was not a reflection of the will of Nigerians, the legal team should also use the opportunity of the trial to strengthen constitutional democracy in the country.

Addressing the team headed by Chief J. K. Gadzama, SAN, at the conference room of his office at the campaign headquarters, Atiku said it was imperative that they work assiduously in reclaiming the mandate not necessarily because of him and the PDP, but to strengthen democracy and the electoral process and for generations unborn.”

Elder Stateman, Musan Musawa Dies At 86

AN ELDER statesman, Alhaji Musan Musawa, is dead.

The death has occured of a reknown broadcaster, a diplomat, and astute politician. Born on April 1, 1937, the deceased died on Tuesday following a protracted illness.

Alhaji Musan Musawa is survived by a number of children and other family members, including the deputy spokesperson of the APC Presidential Campaign Council, Barrister Hannatu Musawa, who is also a weekly columnist with the LEADERSHIP Newspapers Group.

Meanwhile, the President-elect, Asiwaju Bola Ahmed Tinubu, has expressed sorrow over the loss of the elder statesman.

In a statement Tuesday evening by his media office, Tinubu described the late statesman from Katsina State as one of the last bastions of freedom fighters who fought for Nigeria’s independence.

“He was a truly progressive and broadminded statesman. As a young man, he joined forces with like-minded comrades in the defunct Northern Elements Progressive Union (NEPU) to fight for Independence and total liberation of our people.

“In the years since independence Alhaji Musa Musawa continued to ally with progressive movements in and outside the realm of politics to advance the cause of the poor and oppressed in the society.

“He was a progressive politician who paid his dues as a dedicated patriot. Nigeria has lost an illustrious son and we would miss his fatherly counsel at a time we need it the most,” Tinubu said.

The president-elect prayed Almighty Allah to forgive the shortcomings of the departed elder and offer his family the needed consolation at their moment of grief.

The Akere market located located in Apapa was set ablaze in the early morning hours of March 8, 2023. The market is predominantly populated by non-Yoruba traders. It is a large market in Lagos that generates considerable revenue for the State government.

Already, several of the Yoruba speaking traditional leaders in Lagos had issued violent threats to the non-Yoruba speaking population of Lagos – stating that they would “chase them” out of Lagos should they vote for any other political party aside from the APC.

How Tinubu & INEC Chairman Rigged Presidential Elections

Published reports indicate the INEC Chairman had knowledge of what transpired in the failed election. During the build up to the presidential election, the INEC Chairman transferred a certain Chidi Nwafor out of the INEC headquarters in Abuja and resigned him to a desk as an administrative assistant at an office in a rural part of Nigeria.

Chidi Nwafor is the IT expert credited as the developer of the Bimodal Voter Accreditation System (BVAS) used by INEC to accredit voters and to upload results to the INEC web portal. His refusal to reprogram the BVAS to compromise the presidential elections was his offense. Adding gravitas, a former commissioner of Science & Technology to the Governor of Lagos State, Femi Odubiyi, was used to replace Chidi Nwafor. Femi Odubiyi took over the ICT facility in INEC and became responsible for jamming the network that halted transmission of the presidential election results.

APC holds emergency meeting with governor’s ahead of Gubernatorial elections in Abuja

The National Chairman of the All Progressives Congress (APC) Abdullahi Adamu, has met with the party’s governors ahead of Saturday’s governorship and House of Assembly elections.The meeting which was held on Tuesday at the APC National Secretariat in Abuja also had members of the National Working Committee in attendance.

Aside from the governors, all of the party’s flag bearers in the March 11 polls were in in in attendance.

In a post shared on its official Twitter handle, the APC said; Ahead of the Saturday, 11th March 2023 Governorship and State Assembly Elections, the National Chairman, Sen. Northern CSOs calls for punishment of electoral offenders

Joint Conference of Northern States Civil Society Networks says, despite many assurances from the Independent National Electoral Commission before the conduct of the elections, on its preparedness to conduct free, fair, credible and transparent elections, what was witnessed during the last presidential elections on the 25th Feb. fell below the expectations of Nigerians.

The organization stated during it’s press conference held in Kano, says the conduct was a disappointment to Nigerians who have high hope more than before, to witness a historic elections in the country

The coalition said, this could be evidently justified by the number of Nigerians that registered as voters numbering to more than eighty five million, all as eligible voters who could participate in the elections.

”It is however unfortunate that, the number of Nigerians that participated in the last elections of 25th Feb. were apparently not happy with the outcome of the elections especially as the elections were massively characterized with irregularities. Although some of the shortcomings that marred the conduct of the elections, could be summarized into pre, during and post elections”

Addressing the press conference, head of secretariat, Kano peace committee Comrade Ibrahim Waiya said the undemocratic tendencies played out during the pre-election phase, which bordered on lack of internal democracy in the political parties processes that produced the candidates of major parties, had an over spelling effects on the conduct of the general election.

”For instance, the commercialization of the party elections that produced candidates at the primaries, had institutionalized vote-buying which eventually translated and resurfaced in the general election. In addition to the above, the violence that also accompanied the campaign activities which were turned bloody in some states, such as Kano, and some other parts of the country. These ugly practices therefore transcended into mass electoral violence in a number of places during the presidential election.Polarization of the general campaign activities by both politicians and other stakeholders along religion and ethnicity, this had further overheated the polity, and created more division amongst Nigerians.

The group called on authorities concerned to punish electoral offenders of any kind to discourage others from perpetrating electoral offences again in Nigeria.

The Coalition also said those found in the act of intimidating and suppressing voters at polling units must be made to face the full wrath of the law no matter how highly placed they are.

The Coalation also reeled out the observation in the just concluded Presidential and National Assembly elections conducted across the country on February, 25th.

Waiya noted that the elections conducted fell short of the standard of all elections practices and ethics.

“That, INEC has raised so much credibility question on its name and created doubt on the minds of Nigerians regarding INEC preparedness to conduct free, fair, credible and acceptable elections in Nigeria,’’

The CSOs said that the timely distribution of electoral materials especially to LGAs offices were really commendable, with the quick responses to BVAS issues on the election day were also impressive

According to the CSOs: ’The Nigerian security agencies like EFCC, DSS, NDLEA, NSCDC, Nigeria Police Force had performed wonderfully well in ensuring peaceful polls during presidential and national Assembly elections, and that they would continue with the work in the next elections
