Gov. Ayade loses senatorial election in C/River

Gov. Ben Ayade has lost his bid to return to the Senate following his defeat by the incumbent senator representing Cross River North, Sen. Jarigbe Agom-Jarigbe.

Ayade who was in the Senate between 2011 and 2015, lost the National Assembly elections conducted on Saturday with 56,595 votes against Agom-Jarigbe’s of the Peoples Democratic Party (PDP) who scored 76,145 votes.

The returning officer, Dr Emmanuel Emanghe, who spoke on behalf of the Independent National Electoral Commission (INEC) announced the result for the polls around 3:05 a.m. on Monday.

The News Agency of Nigeria (NAN) reports that Agom-Jarigbe, a two-time member of the House of Representatives, was elected into the Senate through a bye-election in September 2021 following the death of Dr Rose Okoh.

Similarly, Ayade who is serving out his two-term as Governor of the state, sought to replace Agom-Jarigbe as the Senator representing Northern senatorial district of Cross River.

However, the re-elected Senator could not be issued with the Declaration Form after his declaration by the returning officer.

Upon demand for the Declaration Form, Agom-Jarigbe was told that it was mistakenly taken to Obudu by the electoral body in the state.

The Resident Electoral Commissioner (REC), Prof. Gabriel Yomere, who spoke on phone said, “the form was mistakingly taken to Obudu but he can be issued with a temporary one pending when the original one will be brought.”

Meanwhile, Godwin Offiono of the PDP, was returned elected for the Ogoji/Yala Federal Constituency election.

Offiono defeated the incumbent lawmaker representing the area, Mr Jude Ngaji of the All Progressives Congress, by 36,651 votes to 32,973 votes.

The Ogoja/Yala Federal constituency result was announced by Dr Wakasor Ofem.

2023 Elections: CNPP Urges INEC To Cancel Results Where BVAS Were Bypassed, Mass Thumb-printing Occurred

Conference Of Nigeria Political Parties (CNPP) has called on the Independent National Electoral Commission (INEC) to immediately cancel election results in parts of the country where the newly introduced Bimodal Voter Accreditation System (BVAS) machines were bypassed during accreditation.

The CNPP in a statement signed by its Secretary General, Chief Willy Ezugwu, recalled that “the BVAS is an electronic device designed to authenticate voters during accreditation based on the 2023 electoral guidelines.

“The legal framework for conducting the 2023 elections consists of the 1999 Constitution of the Federal Republic of Nigeria, as amended; the Electoral Act, 2022; and the Independent National Electoral Commission (INEC) Election Regulations and Guidelines for the conduct of the elections.

“When the commission introduced the BVAS machines into the Nigerian electoral system, the compact device was intended to serve as the only means of verification of the genuineness of the PVCs through the fingerprint or facial authentication of voters during accreditation. All verifications outside the BVAS are invalid.

“On the other hand, uploading the polling unit results to the INEC Result Viewing Portal (IReV) was intended to be in real-time on election day, which was substantially not the case.

“So, we are afraid that the election results from polling units to the INEC Result Viewing Portal (IReV) were suspiciously delayed because even results from different major cities across the country with good internet connections were not uploaded real-time to the INEC results portal.

“In the same vein, INEC officials were also being accused of paypassing the use of BVAS machines for accreditation in some parts of the country, expecially in the North East and North West, leading to allegations of massive thumb-printing and stuffing of ballot boxes.

“Another very noticeable anomaly is on viral videos where clearly under-aged voters in some states were seen thumb-printing ballot papers in parts of the North.

“The use of violence to scare voters as well as vote-buying persisted in parts of the country throughout the presidential and national assembly elections on Saturday.

“We, therefore, call on the electoral body to exercise its powers under the law to cancel results of polling units where violence, vote buying or mass Thumb-printing of ballot papers took place.

“Polling unit officials deployed by the Commission were accused of bypassing the BVAS machines, which is the only means of accreditation of voters. This is not in compliance with the electoral guidelines for the 2023 general elections as released by INEC and any election result from such polling unit must be canceled and rerun ordered.

“We also call on the international community to note these observations and pressure INEC to do the needful by ensuring compliance to its own guidelines.

“The current delay in announcing the results of the presidential election is even raising more suspicion that INEC has an ulterior motive or is acting a script to produce a particular candidate other than the one voted for by Nigerians”, the CNPP stated.

Kogi: INEC cancels 11 polling units results over thuggery, BVAS

The Independent National Electoral Commission (INEC) has cancelled results of 11 polling units in Kogi on Saturday, over thuggery and failure of a Presiding Officer (PO) to operate the BVAS correctly.

The News Agency of Nigeria (NAN) reports that the results of 10 polling units were cancelled in Ofu Local Government Area (LGA) due to activities of political thugs, and a polling unit in Yagba East LGA due to ineptness of a PO.

Dr Alhassan Abdulrahaman, the Collation Officer for Yagba LGA, on Sunday disclosed cancellation in his area, while presenting the results to the State Collation Officer, Prof. Wahab Egbewale (SAN), Vice Chancellor, University of Ilorin.

NAN reports that Abdulrahaman had barely finished his presentation, when Egbewale asked him whether any result was cancelled in the area and he answered in the affirmative.

“Yes Sir, we do have cause to cancel some results in Yagba East Local Government during last Saturday’s Presidential and National Assembly elections.

“At Unit 006 of Ward 10, we have no option than to cancel the results of that particular unit on a simple reason that the PO didn’t know how to operate the BVAS issued to her for the exercise.

“It looks as if she wasn’t trained for the job, because we tried to help her but she couldn’t pick up. We were so amazed.

“At that point we had no option than to cancel the result of that very unit,” Abdulrahaman explained.

Prof. Abdullahi Musa-Yusuf, Collation Officer (CO) for Ofu LGA of Kogi, while presenting his results, said results of 10 units had to be cancelled due to activities of political thugs.

Musa-Yusuf said the political thugs invaded the affected units in Itobe and Ayaji wards and packed away the election materials, a situation he said disrupted the election in those units.

He disclosed that more than 6, 600 votes in those units had to be cancelled.

NAN reports that results of a total of 14 out of 21 Local Government Areas of Kogi were received by the Prof Egbewale led team at the Kogi Situation Room/Collation Centre, including, Bassa, Idah, Igalamela-Odolu, Umala, Okehi and Olama-Boro.

Dekina, Adavi and Ibaji LGAs, whose results could not tally were asked to go and tidy up and return on Monday to represent theirs.

Egbewale, thereafter, thanked all stakeholders including patties’ agents, security operatives, observers, journalists and INEC officials adjourned the collation to 11.am of Monday, Feb. 27 for continuation.

INEC officials held in Ogoja over missing Declaration Form

Some officials of the Independent National Electoral Commission (INEC) have been held in the commission’s office in Ogoja, Cross River over alleged missing “Declaration Form.”

The News Agency of Nigeria (NAN) reports that trouble started when after the declaration of Sen. Jarigbe Agom-Jarigbe as the winner of the Cross River North senatorial district election and he could not be issued with the “Declaration Form” upon demand.

The Ogoja Electoral Officer, Mr Peter Kolo tried to convince the Senator that it would be issued later since the one meant for the senator-elect was not readily available.

This, however, infuriated supporters of the senator who demanded that it be issued immediately or no one would be allowed to leave the office premises.

However, the Resident Electoral Commissioner (REC), Prof Gabriel Yomere said, when responding through a phone call, that he sent the form along with other electoral materials.

Agom-Jarigbe’s supporters, however, blocked the gate of the compound and said no staff of the commission would be allowed to go out until the Declaration Form was presented to the Senator elect.

NAN reports that the issue, which started around 3:05 a.m., was yet to be sorted out as at the time of filing this report.

Meanwhile, Agom-Jarigbe defeated Gov. Ben Ayade of the All Progressives Congress (APC) for the Cross River North Senatorial seat.

The Peoples Democratic Party candidate defeated the governor in the election conducted on Saturday with 76,145 votes against 56,595 votes.

Arrest Of Suspects For An Attempt To Burn Down Takai LGA Collation Centre

… As Two Died when Thugs Set NNPP Campaign Office in Tudun Wada LGA Ablaze; Four Suspects are Arrested

On 26/02/2023 at about 1430hrs, a group of hoodlums suspected to be political thugs attacked the INEC Office of Takai LGA where election results are collated. The hoodlums attempted to set the Office ablaze, but, a swift response from the Police and other security agencies prevented the attack, and four of the suspected thugs were arrested. The collation of the results was concluded peacefully and an investigation is in progress.

Also, on the same date at about 1600hrs, reports were received that, while the collation of results was ongoing at Tudun Wada LGA INEC Office, a group of thugs in large numbers mobilized and attacked the Campaign Office of NNPP House of Representatives Candidate and sets the building ablaze with two unknown persons in a stationary Motor Vehicle inside the building burnt to death as a result of the inferno.

The hoodlums again mobilize and attempted to block the road leading to the INEC Office. Security personnel were immediately mobilised to the scene. One of the thugs was fatally injured and was rushed to Hospital where he died while receiving treatment. Four other suspected thugs were arrested, as well. An Investigation is in progress.

Election violence: SERAP writes Biden, seeks visa bans, property sanctions against perpetrators

Socio-Economic Rights and Accountability Project (SERAP) has urged the US President Joe Biden to exercise his powers “pursuant to the Presidential Proclamations 7750 and 8697 and the Immigration and Nationality Act to ban Nigerian officials, politicians and other perpetrators and sponsors of violence during the just concluded elections.”

SERAP also urged Mr Biden to “use the Global Magnitsky Human Rights Accountability Act to block or revoke the visas of anyone suspected to be responsible for cases of intimidation, harassment and violence during the elections, and to impose asset freezes and property sanctions on them and their families.”

The letter followed reports of cases of election-related intimidation, harassment and violence in several states of the country, including in Akwa Ibom, Enugu, Gombe, Lagos, Edo, Ogun, Osun, Rivers, and Taraba states, and Abuja.

In the letter dated 25 February, 2023 and signed by SERAP deputy director, Kolawole Oluwadare, the organisation said: “The imposition targeted sanctions against suspected perpetrators and sponsors of election-related violence in Nigeria would promote accountability, end impunity, and deter human rights violations.”

SERAP said, “Applying the presidential proclamations, Global Magnitsky Act, and Immigration and Nationality Act as recommended would be very helpful to the efforts to stop further violence before, during and after elections, facilitate free and fair elections, and encourage the people to exercise their right to vote.”

The letter, read in part: “The recommended travel bans, asset freezes and property sanctions should also cover anyone who may perpetrate and sponsor violence and human rights crimes during the postponed elections in 141 polling units, and the governorship elections scheduled for March 2023.”

“SERAP welcomes your government’s publicly expressed commitment to impose visa restrictions on officials, politicians and other perpetrators and sponsors of election-related intimidation, harassment, and violence. We urge you to include asset freezes and property sanctions on the list.”

“Giving serious consideration to our recommendations and promptly implementing them would give meaning to this commitment, and demonstrate the willingness of your government to support and strengthen democracy, citizens’ participation and the rule of law, as well as end a culture of election-related violence in Nigeria.”

“SERAP notes that presidential proclamations 7750 and 8697 underscore the US ‘enduring commitment to respect for human rights and humanitarian law’, which requires that its Government be able to ensure that the US does not become a safe haven for suspected violators of human rights, including election-related intimidation, harassment and violence.”

“The proclamations also aim to help the US authorities to secure peace, promote the rule of law, combat crime and corruption, and strengthen democracies around the globe.”

“Significantly, the presidential proclamations underscore that it is in the interests of the United States to take action to restrict the international travel and to suspend the entry into the United States, as immigrants or non-immigrants, of certain persons who are suspected to be involved in serious violations of human rights.”

“Under Section 212(a)(3)C) of the Immigration and Nationality Act, officials and politicians and other suspected perpetrators and sponsors of election-related violence will be found ineligible for visas to the United States under a policy to restrict visas of those who directly or indirectly undermine democracy in Nigeria.”

“Under these provisions, certain family members of such persons may also be subject to these restrictions. Additional persons who undermine the democratic process in Nigeria—including before, during and after the elections which took place on 25 February 2023 may be found ineligible for U.S. visas under this policy.”

“SERAP urges you to apply the presidential proclamations, the Immigration and Nationality Act, and the Global Magnitsky Human Rights Accountability Act as instruments of foreign policy to promote targeted sanctions against officials, politicians and other suspected perpetrators and sponsors of election violence.”

“Applying these instruments would also end election-related intimidation, harassment and violence, and facilitate equivalent visa bans, asset freezes and property sanctions in other globally desirable locations as well.”

“Proactive initiatives by your government to protect democracy, citizens’ right to political participation and the rule of law in Nigeria would invariably be in the best long-term interests of the US. Such initiatives would also be entirely consistent with the US international obligations.”

“Such sanctions would not violate due process and presumption of innocence principles, as long as the reasons for the sanctions are communicated to those that may be affected. The imposition of travel bans, asset freezes and property sanctions is a preventive and not punitive measure.”

“According to our information, the Presidential and National Assembly elections which took place today across the country were characterized by cases of election-related intimidation, harassment and violence in many states. There are reports of loss of lives, injuries and disruption of the voting process in many states.”

“Armed thugs also disrupted elections in several states of the country including in Akwa Ibom, Enugu, Gombe, Lagos, Edo, Ogun, Osun, Rivers, and Taraba states, and the Federal Capital Territory.”

“Armed thugs snatched ballot boxes, took away election materials, broke chairs and dispersed voters in several areas of in Kogi State, including in Anyigba Dekina towns. Thugs also reportedly attacked polling units in polling units in Niger, Delta and Katsina states, stealing at least eight BVAS machines.”

“Presidential and national assembly elections were postponed in 141 polling units in Yenagoa, the capital of Bayelsa State because of incidents of election-related intimidation, harassment and violence.”

“A pregnant woman identified as Ruth Osah, and a member of a local security outfit, Mark Orduize, were allegedly killed at a polling unit in the Ubimini community, Emuoha Local Government Area of Rivers State. One person was reportedly killed in Taraba State.”

“Armed thugs also injured two voters in Akwa Ibom State before carting away a Bi-Modal Voter Accreditation Machine System machine for units 11 and 12 at the Oniong West Ward I in the Onna Local Government Area of the state.”

Thugs also reportedly snatched ballot boxes and voting materials at the Oredo Ward 4 Unit 42 on Butcher Street, Benin, Edo State, and chased away the polling officials. Political thugs also destroyed 24 ballot boxes in at least eight polling units in Abuja.”

“On Dipolubi Street in the Surulere area of Lagos, a woman, Efidi Bina Jennifer, was allegedly stabbed by thugs at the polling unit. A polling unit outside the Oba Elegushi Palace at Ikate in Eti-Osa, Lekki, was also reportedly attacked by thugs, who carted away ballot boxes and chased away electoral officers.”

INEC Must Not Allow This Election To Be Rigged – ADC National Chair, Ralphs Okey Nwosu

The National Chairman of the African Democratic Congress [ADC], Chief Ralphs Okey Nwosu has called on the management of the Independent National Electoral Commission [INEC] to follow the path of honour by maintaining their policy of continuous improvement of the nation’s electoral systems and process which they have done so well and committed so much resources build.

They must not at this time collude with unpatriotic elements and self-serving politicians to compromise the integrity of the commission and our democracy. The scandalous flirtation between some of its ad-hoc staff and principal officers is capable of discrediting the effort of the commission, the political parties and Nigeria citizen especially the youths to ensure that our nation takes its rightful position in the comity of nations. He calls INEC to ensure that the right thing is done in light of the unfolding events surrounding the ongoing presidential election of 2023. It smacks of gross irresponsibility for the commission and its staff to attempt to mess with the much prized BVARS and servers in spite of the commitment and understanding of all stakeholders and our international friends”.

The National Chairman made the call in a Press Statement made available to pressmen in Abuja where he cited the serious works and efforts put in by the electoral umpire and commended them for conducting the 2023 general elections under very difficult circumstances but urged them to endeavour to finish well to help our nation heal and democracy to continue to advance.

While commending the INEC, Chief Okey Nwosu urged the INEC to remain neutral and unbiased in its execution of this critical election. “The voices that spoke so loudly and clearly cannot be allowed to be drowned by the evil machination of a few that had put Nigeria in darkness since independence. The unfolding incidents around the many regions are simply unfortunate and near despicable.”

Chief Okey Nwosu said the liaison between INEC and Governor Wike and some other influential persons in Imo, Edo, Delta and Lagos, almost marred the great preparation and readiness of the commission to give Nigerians a quality election that is adjudged as free, fair and credible. The noticeable and embarrassing irregularities appear suspicious to the citizens of Nigeria and to the many international observers who came from as far as the United States of American, European Union, South Africa and other countries.

The political shenanigans include the stampede, hijack and destruction of electoral materials in Imo state, and crude fifth columnists’ antics of Governors of Imo, Rivers, Kaduna and the managers of His Excellency, Bola Ahmed Tinubu campaign organization”.

The youths and majority of our citizens have made so much sacrifice for this day. It behooves INEC and President Buhari to take whatever steps necessary to correct the abnormalities of today in all carry over elections and uphold the integrity of the nation’s electoral process. After 24years, our democracy should be making steady progress.”

He continued that “residents in Rumuonhwa polling unit in Rivers state, have cried out over claims made by the INEC adhoc staff that they forgot the Presidential ballot papers and so they would only proceed with the National Assembly elections. A woman who was at the polling unit and recorded a video demanded for INEC to do the right thing and not prevent them from casting their votes for their preferred candidates”. Nwosu questioned, how can INEC say they forgot the ballot papers when they went to the polling station to conduct the Presidential election?

All SPOs in Obio Akpor LGA disappeared with BVAS password for uploading results, only for the CSO to Governor Wike to appear with armed policemen, shot sporadically in the air and then took away all the BVAS machines to Obio Akpor LGA Headquarters. It seemed planned in connivance with the INEC officers and Adhoc team”.

Concerning the upload of results and the faults that suddenly developed by the BVAS, Chief Nwosu frowned at the electoral umpire. He indicated that information from our party’s agents in the field has it that in places like Agege, Kosofe, Oshodi-Isolo, Surulere, and Ibeju Lekki in Lagos State amongst others where results show that the Labour Party won convincingly, the INEC officials claim that the BVAS suddenly developed fault. “The developing third force is a collective effort and sacrifices of Nigerian youths following the tragedies of the end SARS and cluelessness of the political elites, executive branch and legislators. The Nigeria youths and citizens deserve their victory and no wedge must be placed on their way”.

It is beyond reason that in Lagos, many of the INEC staff refused to upload the results for the presidential election. This is as they uploaded the results of Senate and House of Representatives.” According to eyewitnesses, the INEC and their collaborators were using the police to drive agents of the Labor party, the ADC Star Alliance and their supporters out of the voting places. The INEC staff claim they have concrete instructions from the INEC headquarters not to upload. “Why must this be, especially after the promises and Peace Accord?

Chief Nwosu continued to add that “INEC must provide a clear and immediate explanation why the results were stopped from being uploaded. It was done in Osun and in Ekiti, and we set the protocol for this election before all stakeholder. Who is subverting the process?”

Nigeria cannot be allowed to descend to anarchy. We have come a long way. INEC and the federal government should ensure the anomalies of the elections are rectified. The people of Nigeria have spoken and they spoke loudly and clearly. INEC must not allow this election to be rigged.”

INEC Adhoc Staff Beaten To Coma For Thumb Printing In Abuja

In the Lugbe community in Abuja at the primary school polling unit 009, voting was said to have not taken place.
According to information received, he Adhoc staff did not arrive the voting venue. This was as the would-be voters assembled to cast their vote. After having waited from the morning hours, one of the INEC staff arrived without the ballot papers. They claimed they were not given ballot papers.
Through the watchful eyes of some vigilante resident, they sighted one of the INEC Adhoc staff, a youth corper, locked in one of the classes. He was has thumb printing almost all the ballot papers for the ruling party of the All Progressive Congress [APC].
As a result, they crowd began beating him. According to an eyewitness, “they have beaten hell out of him…..I just pray he doesn’t die“.
This unit has over 6000 registered voters.

Breaking: Labor Party Issues Official Statement On INEC Officials Refusing To Upload Presidential Election Results In Lagos, Delta

The National Chairman of LP, Julius Abure, has raised alarm on the impunity that is presently happening across the entire Lagos state where the results of the presidential elections collated in various polling units in the state are not being uploaded to the Central Server.

According to Julius Abure, the officials of the Independent National Electoral Commission, INEC in connivance with the security agencies, are claiming that the BVAS have suddenly developed a fault and, therefore cannot function.

Abure said that information from the party’s field men has it that in places like Agege, Kosofe, Oshodi-Isolo, Surulere, and Ibeju Lekki, amongst others where results shows that Labour Party won convincingly, the INEC officials claim that the BVAS suddenly developed fault.

This fault is only when it concerns uploading results of the presidential election.

According to him, “Information reaching me has it that in Lagos, they have refused to upload the results for the presidential election, they have uploaded that of the Senate and House of Representatives but for the presidential, they have refused.

And they are using the police to drive our agents and supporters out of the place. And they said that they have firm instructions from INEC headquarters not to upload.

“For example, in Kosofe, they put the collation centre in a Local Government Area Headquarters. The place is surrounded by APC and people are afraid of their life. They are not uploading, they said that they have been giving instruction to insist that the BVAS is faulty.

“And most of the places we won, but they have refused to upload.

“As I speak, APC officials are in Yaba office of INEC negotiating with the officials. What I have said now is happening in Agege, Kosofe, Oshodi-Isolo, Surulere, we have this situation all over. 

“In Ibeju Lekki, our local government chairman who attempted to stop them was arrested by the police.”

Abure said that a similar situation is playing out across the collation centres in Delta State.

He, however, called on INEC to ensure that only genuine and verifiable results generated from the various polling units should be uploaded.

He also called on the police to help this democracy to work and should resist the lure by the politicians to mar the gains of democracy by refusing to be used to deny Nigerians their choice of leaders.
