Breaking News: Former Imo Governor, Ihedioha Withdraws from 2023 Imo Guber Election, Says…

0

By Izunna Okafor, Owerri

A gubernatorial aspirant under the Peoples Democratic Party (PDP) in Imo State, Mr. Emeka Ihedioha, has writingly withdrawn from the forthcoming governorship election in the state.

Ihedioha, who is a former governor of the State, announced his withdrawal in a letter dated March 27, 2023, and addressed to the leadership of the party in the state.

According to him, his reason for the withdrawal is for emergence of a consensus candidate under the Party, for the November 11 governorship race. His withdrawal is coming few days after he was screened and cleared by the PDP, which qualified him to join the Party’s primary election, ahead of the gubernatorial race.

Recall that Chief Ihedioha was dethroned from the Imo State Governorship seat by the Supreme Court in January 2020, barely seven months after he was sworn in as the Governor of the State.

The seven-man panel led by Chief Justice Tanko Muhammad unanimously declared Hope Uzodimma of the All Progressive Congress (APC) as the winner of the March 19, 2019 governorship election in the state.

The appellant, Uzodimma had contended that he scored the highest number of votes in the election but the Independent National Electoral Commission (INEC) returned Ihedioha as the governor of the state.

Justice Kudirat Kekere-Ekun who delivered the judgment declared that the votes due to Uzodimma were unlawfully excluded from the 318 polling units and should be added to his votes.

The apex court considered the submissions of a principal witness who was on a subpoena to present results and held that the lower court was wrong in its ruling.

Justice Kekere-Ekun subsequently declared Uzodimma as the validly elected governor, and the certificate of return issued to Ihedioha was withdrawn by INEC and given to Uzodimma, who was consequently sworn-in in 2020, and has remained in the seat till date.

Former Imo State Governor, Emeka Ihedioha has withdrawn from the Peoples Democratic Party (PDP)’s governorship primary in the South-East state.

The former governor was screened and cleared a few days ago by the PDP to contest the party’s primary ahead of the November 11 governorship election in Imo State.

However, in a letter dated March 27, 2023, Ihedioha informed the PDP leadership of his “personal sacrifice” for a “consensus candidate” by the party.

In January 2020, the Supreme Court sacked Ihedioha as the governor of Imo State after barely seven months in office.

The apex court considered the submissions of a principal witness who was on a subpoena to present results and held that the lower court was wrong in its ruling.

Justice Kekere-Ekun subsequently declared Uzodimma as the validly elected governor and the certificate of return issued to Ihedioha was withdrawn by INEC and given to Uzodimma.

Adopt Orji Kalu as Sole Candidate for Senate Presidency – Group Tells Southeast Senators

1

Press Release

As the battle for Senate Presidency hits up, a frontline socio-political organisation known as Democracy Coalition has advised Senators-elect from the Southeast region to rally round Senator Orji Uzor Kalu because Senator Kalu is the only ranking Senator of APC extraction from the zone who meets the Senate Standing Rules for the election of principal officers for the 10th National Assembly.

In a statement released to newsmen in Lagos on Tuesday by the National Coordinator of the group, Mr. Michael Ehineta, the group said, the current approach where every Tom, Dick and Harry from the zone is battling for the position instead of adopting a candidate with requisite experience and knowledge of the workings of the National Assembly would only make the Igbo race to lose more political relevance in Nigeria.

Noting that a situation where first time Senators-elect are campaigning for the position when they know that Senate Standing Rules on election of principal officers has made their ambition dead on arrival only leave bitter taste in the mouth.

The group advised Igbo Senators-elect to reflect on how the race is balkanizing the South East politically because of the thoughtless, selfish and transactional type of politics some politicians from the zone have adopted recently.

Adding that Dr. Nnamdi Azikiwe, M. I. Okpara, Akanu Ibiam, Mbazulike Amechi and other notable politicians who gave voice to the region at independence would not be happy if the zone loses the number three position because of selfish interest.

The group therefore enjoined Igbo leaders of thoughts to rise up to the occasion by mobilizing support for Senator Orji Uzor Kalu to become the 10th Senate President of Nigeria in June.

Signed:

Mr. Michael Ehineta
National Coordinator,
Democracy Coalition.

Oil Exploration Activities Begin In Nasarawa State

0

President Muhammadu Buhari on Tuesday declared that the discovery and drilling of oil in Nasarawa State will lead to greater prosperity for Nigerians as well as enhance overall energy security for the country.

In his virtual message to the official spud-in of the Ebenyi-A Well located in the Middle Benue Trough, in Obi Local Government of Nasarawa State, the President said the surrounding communities would particularly benefit from the value created by the exploration and eventual production activities.

The President directed NNPC Limited and its partners to take due care of the environmental consequences of these oil exploration activities and to mitigate the negative effects.

He thanked the Government and people of Nasarawa State- the host community- for their unfettered support and collaboration towards the success of this exploration campaign.

The President recalled that the official commencement of drilling activities in the Middle Benue Trough is in line with ongoing campaigns for the exploration of crude oil and gas in the Nation’s Frontier Basins.

He listed the Chad Basin, Dahomey Basin, Anambra Platform, the Calabar Embankment, Sokoto Basin, Bida Basin, Benue Trough as well as the Ultra-Deepwater Niger Delta as areas where NNPC is extending its crude oil exploration.

‘‘This is consistent with the commercial discoveries of hydrocarbons in the Kolmani Area of the Upper Benue Trough.

‘‘I am pleased to note that activities are currently ongoing to develop the Kolmani petroleum discoveries to commercial production to add to the nation’s considerable hydro-carbon assets.

‘‘I am encouraged by the enormous work done by NNPC Limited to exploit the prospects in the Middle Benue Trough, leading to the event of today.

‘‘I congratulate NNPC Limited, the Nigerian Upstream Petroleum Regulatory Commission and other partners for their immense contributions towards making this day and this event possible,’’ he said, directing Governor Abdullahi Sule of Nasarawa State and Group CEO, NNPC Limited, Mele Kyari to spud on his behalf.

EFCC Asks Court to Dismiss Gov Yahaya Bello’s Application to Vacate Forfeiture Order on 14 Properties, N400m

0

The Economic and Financial Crimes Commission, EFCC, on Tuesday, March 28, 2023, urged Justice Nicholas Oweibo of the Federal High Court sitting in Ikoyi, Lagos to dismiss the application by Kogi State Governor, Yahaya Bello, seeking to vacate the forfeiture order in respect of 14 properties and the sum of N400m.

The court had, on February 22, 2023, granted a preservation order of the properties linked to the Kogi State government and reasonably suspected to have been derived from unlawful activities, pursuant to Sections 9 and 10 of the Proceeds of Crimes (Recovery and Management) Act, 2022.

The properties including “Hotel Apartment Community, Burj Khalifa lying, being and situate at, Plot 160 Municipality NO 345-7562, Sky View Building No 1, Property No 401, Floor 4, Dubai U.A.E.”, were reasonably suspected to have been derived from unlawful activity.

At the resumed sitting today, the EFCC counsel, Rotimi Oyedepo, SAN informed the court that the preservation order had been published in the Punch Newspaper, in line with the court’s directive to advertise the same in one of the national dailies.

Oyedepo said: “We were directed to make a publication of the said Order and we have complied with the order of the court.

“There is an affidavit to the Order dated 22nd February, 2023, which was complied with on the 24th February, 2023.

“Sequel to that, we have received a notice of intention to oppose the making of the preservation order and we have equally responded”.

Responding, the Kogi State Governor, through his counsel, Abdulwahab Mohammed SAN, sought to vacate the order of the court, saying, “We have an application subject to your lordship’s convenience. We are ready to move the application. It was filed on March 9, 2023. The application is seeking your indulgence to vacate the order of the court made on the 22nd of February, 2023.

He argued that most of the properties sought to be forfeited were acquired by Bello before he became the Governor of the state and that the Commission lacked the power to proceed against the governor as he enjoys immunity under the constitution.

“By virtue of the position of the applicant (Kogi State Governor), you cannot proceed against him under any law, according to Section 308 of the Nigerian Constitution.

“If you want to prosecute or forfeit his properties, you have to wait till he no longer enjoys those benefits of a Governor,” he argued.

He, therefore, urged the court to grant his client’s prayers and vacate the order

In opposing the application, EFCC counsel Oyedepo relied on depositions in the 12-paragraph counter-affidavit and a written address dated 28 March, 2023, stating that the applicant failed to reply to the counter-affidavit made by the prosecution.

“In Usman against Garke, it was reported in 2003, LPLR 3431, Supreme Court, and our submission is that failure to reply to the counter-affidavit has a single legal consequence that the respondents are agreeing to the application. We urge your lordship to hold that the failure to respond is deemed admitted.

“We have cited authorities to this effect, one of which is Patience Jonathan and the FGN, in paragraph 1.08 of our submission. The Proceeds of Crime (Recovery and Management) Act, 2022 prescribes the mode of challenging the preservation order of the court and the steps to be taken by the party challenging the making of the preservation order.”

Oyedepo submitted that one of the requirements that the application must contain is that the applicant must show his interest in the property concerned.

“Apart from Paragraph 4H and I of the affidavit in support of the notice of intention, there is nothing before this Honourable court showing, by way of credible evidence, how the properties were acquired.

“In our counter-affidavit, we have established how the properties were acquired and there is nothing challenging how the properties were acquired.

“What was deposed is that, most of the properties were obtained before he became Governor of Kogi State and the properties were not acquired through illegal means.

‘”Without establishing the interest of the applicant, the application is bound to fail.”

On the immunity clause as contained in Section 308 of the 1999 constitution, Oyedepo said: “the Provision of S308 will not and cannot be construed to a ridiculous extent of preventing the state from investigating the beneficiary of the section.

“As far back as 2002, in the case of Fawehinmi and IGP, the court mentioned that a person protected under S308 can be investigated; and the fact that someone is under immunity does not prevent the state from investigating.

“Where a state governor is reasonably suspected to have committed a financial crime, the state can investigate for evidence that will be used in prosecution when he no longer enjoys the immunity.”

Oyedepo also argued that the steps the prosecution was taking “is a step for preservation and it cannot be stopped.”

He further told the court that, out of the entire assets that the EFCC seeks to preserve, only one asset was declared in the applicant’s Declaration of Assets Form and that nothing had been said in the affidavit to challenge “the reasonability of our suspicion.”

He, therefore, urged the court to dismiss the prayers of the applicant and order him to tell the court how the properties were acquired.

Justice Oweibo adjourned the matter till April 20, 2023 for ruling.

US government threatens TikTok owners to sell app or face ban

BY SULE TAHIR.

The United States government has instructed the owners of the Chinese video-sharing app, TikTok’s Chinese to sell their shares or face a potential ban on the app in America.

According to reports, the US President Joe Biden administration was embarking on dramatic moves to possibly block the TikTok app in the North American country amid fears of its user data being shared with the Chinese government.

While Biden has raised many concerns on how TikTok could endanger data in the US, this is the first time under the administration that a ban has been threatened, Sky News said on Thursday.

In 2020, Donald Trump was stopped by US courts when he attempted to prohibit TikTok, which is owned by Beijing-based ByteDance.

TikTok, which has more than 100 million US users, has already been muffled by the White House after it ordered government agencies to delete the app on federal devices and system.

NAFDAC raise alarm over influx of contaminated eye drop

0

BY SULE TAHIR.

THE National Agency for Food and Drugs Administration and Control (NAFDAC) has alerted Nigerians to be wary of the rampant influx of contaminated EzriCare and Delsam Pharma Artificial Tears eye drops as fake and contaminated eye drops, and people should indulge patronage.

The recall is contained in a public alert with No: 008/2023 signed by NAFDAC Director-General, Prof. Mojisola Adeyeye, in Abuja on Sunday.

She said that the eye drop was recalled in February due to suspected contamination with pseudomonas aeruginosa, a highly resistant bacterium.

According to her, since the recall, the U.S. Centre for Disease Control (CDC) has reported 68 patients across 16 states with health problems from the bacteria, including eye infections.

Other problems associated with the eye drop were permanent loss of vision, surgical removal of eyeballs and a case of death with a “bloodstream infection”.

The NAFDAC boss said that laboratory testing identified the bacteria in opened EzriCare bottles from multiple sources according to the CDC.

She stated that unopened bottles were being examined to check whether contamination occurred during manufacturing.

“Although the products are not in NAFDAC database, importers, distributors, retailers and consumers are therefore advised to exercise caution and vigilance within the supply chain.

“Importation, distribution, sale and use of the above mentioned products must be avoided.

“Members of the public in possession of the above listed products are advised to discontinue sale or use and submit stock to the nearest NAFDAC office,” the NAFDAC added.
