NYSC Service Not A Disqualification For Ministerial Appointment, Court Dismisses Suit Challenging Musawa’s Appointment As Minister

A Federal High Court, Abuja, has dismissed a suit seeking to reverse the appointment of Hannatu Musawa as Minister of Art, Culture and Creative Economy by President Bola Tinubu.

Justice James Omotosho, in a judgment, held that the plaintiffs lacked locus standi (legal right) to institute the suit.

Justice Omotosho also held that even where the plaintiffs were vested with the legal right to file the matter, the suit, itself, lacked merit.

President Bola Ahmed Tinubu had, on July 27, 2023, transmitted Musawa’s name, among names of minister-designates, to the Senate for confirmation.

Musawa, a lawyer and immediate-past Presidential Adviser on Culture and Entertainment Economy, was screened by the Senate on Aug.1, 2023, and was sworn in as minister on Aug. 21, 2023.

At the time, the minister who hails from Katsina State was appointed, she was alleged to be a serving National Youth Service Corps (NYSC) member.

Against this backdrop, the Incorporated Trustees of Concerned Nigeria, Chief Dr Patrick Eholor and Thomas Marcus, who were 1st to 3rd plaintiffs respectively, filed the suit before Justice Omotosho.

In the suit marked: FHC/ABJ/CS/1198/23 filed Aug. 30, 2023, the plaintiffs sued President Tinubu, the Attorney-General of the Federation (AGF) and Musawa as 1st to 3rd defendants respectively.

They prayed the court to determine whether by provisions of Section 2(1) and (3) of the NYSC Act and Section 4(9) of the NYSC Bye-Laws (Revised 2011), Musawa, who was a corps member at the time, was not prohibited from becoming a federal minister.

They also urged the court to determine “whether by the provisions of the 1999 Constitution (as amended), whether the same qualification of a member of House of Representatives is not also the same qualification for the appointment of 3rd defendant (Musawa) as a minister and whether the same qualification is not mandatory for her to be a federal minister of Nigeria.”

Upon favourable resolution of the questions, the plaintiffs sought an order nullifying the initial recommendation, resolution to be a minister, appointment and swearing in of Musawa as a minister.

They sought an order setting aside the swearing-in of the minister.

They equally sought an order of mandatory injunction setting aside all official actions as may be carried out by her acting in any official capacity from the commencement of and swearing in of the minister to the final conclusion of the suit.

They also prayed the court to make an order for payment of general damages in the sum of N100 million against all the defendants.

In their affidavit, they argued that Musawa was mistakenly screened by the Senate and appointed as a minister to supervise the Ministry of Culture.

But the 1st and 2nd defendants in a joint preliminary objection dated and filed Feb 15, sought a dismissal of the suit for want of jurisdiction.

They argued that her appointment was done in line with extant laws as she was duly nominated, screened by the Senate and appointed by the president.

According to them, there is no law that hinders the 1st defendant from appointing a person still serving as an NYSC member as a minister.

They further argued that the only qualification is the same as a person contesting for the post of a member of the House of Representatives.

They submitted that the NYSC certificate or completion of NYSC is not amongst the basic requirements for appointment as a minister, urging the court to dismiss the suit on the grounds that the plaintiffs are incompetent to institute this suit.

On her part, Musawa, through her lawyer, argued that the 1st plaintiff was a non-existent entity and thus, not a juristic person to institute the action.

Also, she argued that none of the plaintiffs had shown how they had suffered special injury to the exclusion of all Nigerians to qualify them to maintain the suit.

In the judgment delivered on Tuesday by Justice Omotosho and the certified true copy of it sighted on Thursday, the judge agreed that for a person to be qualified for appointment as at minister, he must fulfil the conditions in Section 147 (5) of the 1999 Constitution.

According to him, Section 147 (5) says no person shall be appointed as a minister of the Government of the Federation unless he is qualified for election as a member of the House of Representatives.

“It is clear from the above that the qualification for being a member of the House of Representatives will guide the qualification for being a minister of the Federal Republic of Nigeria,” he said.

The judge said that based on Section 65, and subject to Section 66, a person shall be qualified for election as a member of the House of Representatives if he is a citizen of Nigeria and has attained the age of 30 years.

He said it equally provided that a person shall be qualified for election under Subsection (1) of this section if he has been educated up to at least school certificate level or its equivalent; and he is a member of a political party and is sponsored by that party.

“The constitution has made it crystal clear the qualifications and grounds for disqualification as a minister and being a serving corp member is not one of such grounds.

“As a matter of fact, a person to be appointed as a minister only needs to show that he has been educated up to secondary school level.

“Thus the National Youth Service Corps Certificate which can only be attained by graduates who have completed the scheme is a surplusage to the basic requirements to be a minister.

“I therefore hold that there is nothing stopping the 1st defendant (Tinubu) from appointing the 3rd defendant (Musawa) as a minister as she is eminently qualified to be so appointed.

“In final analysis, the plaintiffs lack locus standi to institute this action.

“Even where they are vested with locus standi, the suit lacks merit — same is hereby dismissed,” Justice Omotosho declared.

U.S. Govt Condemns ‘Arbitrary Arrests’ Of Godwin Emefiele And Nnamdi Kanu By DSS

The United States Government has criticized the arbitrary arrests of Godwin Emefiele, the former governor of the Central Bank of Nigeria, and Nnamdi Kanu, the leader of the Indigenous People of Biafra (IPOB), by security personnel in Nigeria.

 

In its ‘2023 Country Reports on Human Rights Practices: Nigeria,’ published Tuesday on the U.S. Department of State’s website, the U.S. highlighted concerns about lengthy pre-trial detention, denying detainees access to court, and frustrating the country’s judicial system.

 

The report revealed that in the prosecution of corruption cases, law enforcement and intelligence agencies did not always follow due process, resulting in the arrest of suspects without appropriate arrest and search warrants.

 

Regarding Emefiele’s case, the report detailed that he was detained by the Department of State Services (DSS) “for investigative reasons” on June 10.

 

Although a Federal High Court in Lagos granted him bail on July 25, ordering him to be held at the Ikoyi Correctional Centre until bail was made, the DSS attempted to arrest him again, leading to a confrontation between DSS agents and Nigerian Correctional Service officers.

 

Similarly, Nnamdi Kanu, designated as a leader of a government-designated terrorist organization, IPOB, was detained by the DSS on national security grounds.

 

Despite being charged with treason, terrorism, and illegal possession of firearms, Kanu fled abroad in 2017 after skipping bail, only to be arrested and returned to Nigeria in 2021.

 

In 2022, an appeal court in Abuja dropped all charges against Kanu and ordered his release, but the federal government appealed.

 

The Supreme Court overturned the appeals court ruling on December 15, stating that Kanu faced terrorism charges despite acknowledging rights violations during his arrest and extradition. Kanu remained incarcerated at the year’s end.

 

The report also highlighted challenges within Nigeria’s judicial system, including a shortage of trial judges, trial backlogs, endemic corruption, bureaucratic inertia, and undue political influence.

 

It said delays in cases were exacerbated by logistical issues, such as the need for more vehicles to transport detainees to court and authorities losing case files.

 

Overall, the U.S. expressed concerns about Nigeria’s judicial system’s inadequacies, emphasizing the need for fair and transparent legal processes to uphold human rights.

The Prime Minister of the Netherlands noted that President Tinubu’s economic reforms have engendered greater confidence in the Nigerian economy by international investors and that Dutch investors have activated another set of $250 million worth of new investments over the next few months, including a $100 million investment in a waste-to-wealth industrial facility in Lagos State.

“You are promoting democratic governance and the solutions it can bring in dealing with problems of development. I saw how you went through democratic channels to remove an incumbent president in 2015 in partnership with President Buhari and how that has led to development in your country.

“I saw you take the courageous decision to deal with fuel subsidies and other reforms, and we are interested in what allowed you to take the decisions that many before you could not take. And you took those decisions early in your term. It shows rare determination. And your stand in ECOWAS, all of these point to your commitment in leadership,” the Prime Minister stated.

President Tinubu further expressed his firm commitment to develop the developmental partnership between the European Union (EU) and Nigeria, noting that symbiotic economic ties remain the best long-term path to sustainable and mutual prosperity rather than one-sided relationships in which bilateral trade is skewed too much in one direction.

NNPC Ltd Says Cause of Tightness in Fuel Supply Resolved

ONSA Arms Deal: N4.6b was Traced to Bafarawa’s Son-Witness Tells Court

The Second Prosecution Witness, 2PW, Hamza Abdullahi in the trial-within-trial of former Sokoto State governor, Attahiru Bafarawa and four others, on Wednesday, April 24, 2024, told Justice Y. Halilu of the Federal Capital Territory, FCT, High Court, that a sum of N4.633billion was traced to the account of Dalhatu Investment Limited where Bafarawa’s son, Sagir Attahiru Bafarawa and one other, simply identified as Nasir, were directors, with the former being the sole signatory to the company’s bank account.

 

Abdullahi stated that in 2015, he was the second-in-command of Special Task Force, Fraud Investigation on Arms, Defence Equipment Procurement in the Office of the National Security Adviser, ONSA, on the activities of 78 companies that received money from ONSA without justification, adding that Dalhatu Investment Limited was among the companies.

 

“From the report we received from ONSA, when we scrutinized the report, we traced the sum of N4.633billion paid to Dalhatu Investment Limited Account, domiciled in United Bank of Africa, (UBA), with Sagir Attahiru Bafarawa as the sole signatory of the account,” the witness said.

 

Abdullahi further informed the court that Sagir Attahiru Bafarawa, who is the fourth defendant was interviewed on November 25, 2015 by the investigation team and that he made his statement voluntarily.

 

“My Lord, I witnessed the statement dated 25/11/2015 of Sagir Attahiru Bafarawa. He was interviewed in my presence, the statement was also recorded in my presence. At the conclusion of the written statement, I read it to him. Thereafter, I endorsed the written statement. I equally endorsed the second statement at 4pm and it was concluded by 4:25pm, the same day. I witnessed it, my name and signature were there,” he said.

 

The PW2 further informed the court that no kind of promise was made to the defendant and that he was neither threatened nor induced into writing any of the statements. “My Lord, there was nothing like promises made to the accused, threat or inducement. To the best of my knowledge, there was nothing like that. It was a very conducive environment and that was the Secretariat of the Special Task Force at the Head Office then. The secretariat is the conference room of the Chairman, and no member of the Special Task Force is authorized to make any promise in the course of investigation.

 

“When Sagir Attahiru Bafarawa honored our invitation, he came with his lawyer and he was confronted with the evidence that we have. Afterwards, he said he needed to consult his lawyer and later volunteered his written statement. These statements were based on the fact of the evidence we have on the company,” he said.

 

He also stated that the defendant promised to avail the investigation team with detailed analysis of the beneficiaries of the said fund traced to his account, adding that he voluntarily came forward with the details. “I have decided to make this statement without my lawyer. Attached here are the details signed by me,” PW2 quoted from the statement of the defendant.

 

Justice Halilu thereafter adjourned the matter till May 22, 2024 for the defence to open their case in the trial-within-trial.

Alleged N3bn Fraud: How Oyo-Ita, Allies Diverted Public Funds to Private Companies

Prosecution Witness Eight, (PW8), Hamma Adama Bello in the trial of former Head of Service (HoS), Winifred Oyo-Ita on Thursday, April 25, 2024 narrated before Justice James Omotosho of the Federal High Court, Maitama, Abuja, how the defendant and her subordinates allegedly diverted public funds into their private companies.

Oyo-Ita, the first defendant is facing criminal prosecution by the Economic and Financial Crimes Commission, EFCC alongside her special assistants, Ugbong Okon Effiok (seventh defendant), Garba Umar (fourth defendant) and six companies: Frontline Ace Global Services Limited, Asanaya Projects Limited, Slopes International Limited, U and U Global Services Ltd, Prince Mega Logistics Ltd and Good Deal Investments on 18-count charges bordering on misappropriation, official corruption, money laundering and criminal diversion of funds to the tune of over N3billion.

The witness, while being led in evidence by prosecution counsel Faruk Abdullahi and H.M. Mohammed, told the court that Oyo-Ita used Slopes International Limited and Good Deal Investments Limited-fifth and sixth defendants respectively, to fraudulently award government contracts to herself through the fourth defendant, Umar. The first entry transaction of Good Deal Investment Ltd on February 2019 showed that money was paid into its Zenith Bank account to the tune of N42,748, 201.47 ( Forty-two million, Seven Hundred and Forty-eight Thousand, Two Hundred and One Naira, Forty-seven kobo). Umar, the witness said incorporated the company with Oyo-Ita’s full knowledge.

“We called for the account statements of these two companies, upon analyzing them, we realized he (Umar) was paid several sums of money from the Ministry of Power, Works and Housing where he is an employee. And upon interviewing the fourth defendant, he admitted that he was also a contractor. He also admitted to have paid the first defendant on several occasions from the proceeds of the transaction,” the witness said.

On April 27, 2019, the witness disclosed that a transfer of N20, 2027, 142 (Twenty Million, Two Thousand and Twenty-seven, One Hundred and Forty-two Naira) was made in the name of Ibrahim Madu to the Zenith Bank account of Asanaya Projects Ltd. The mandate card of the account bears the signature and photo of the seventh defendant, Effiok.

Investigation, according to the witness, also revealed that the seventh defendant incorporated Asanaya Projects Ltd in his name with the knowledge of the first defendant and that approvals were granted and payments made to the seventh defendant either through his personal account or to the account of the company.

According to the witness, “The seventh defendant upon interview, confirmed he never travelled for most of the funds he received and that the first defendant was aware and benefitted on several occasions from the funds. The account of U and U Global Services Limited was also opened by the seventh defendant.

“In summary, from 2015 to 2018, U and U Global Limited received several payments in the form of Duty Tour Allowances and estacodes. Sometimes, payments from the federal government were made directly to the account, for instance, on March 24, 2016, he received N40, 313, 453. 58 (Forty Million, Three Hundred and Thirteen Thousand, Four Hundred and Three Naira, Fifty-eight Kobo). This particular payment was from the federal government.”

Further in his testimony, the witness stated that “Exhibit O is the Fidelity Bank account of Prince Mega Logistics Ltd. On March 27, 2018 and April 6, 2018, there were four entries, N4, 950, 000 (Four Million, Nine Hundred and Fifty Thousand Naira); N3,946,000; (Three Million, Nine Hundred and Forty-six Thousand Naira); N4,676,000 (Four Million, Six Hundred and Seventy-six Thousand Naira) and N1,478,000 (One Million, Four Hundred and Seventy-eight Thousand Naira) from Thomson Titus Okure who used to be a colleague of the seventh defendant in the Account Department. There were also outward payments to Ignom, Minaro Blessing, Winifred Oyo-Ita, Olarenwaju Godman Olushola and the seventh defendant is the sole signatory of this account.”

Speaking further, he said “I also want to add that we invited the first, second and seventh defendant at different times to our office and interviewed them. In the case of the first defendant, we printed chats from her phone and saw conversations she had with contractors, subordinates and permanent secretaries, she also voluntarily made a statement to the EFCC.

The matter was adjourned till April 30, 2024.

Traders Count Losses, As Nwifuru Demolishes Shops In Ebonyi State Amid Economic Hardship

Traders and landlords in Abakaliki, the capital of Ebonyi State, are counting their losses following the demolition of shops and residential buildings along Ogoja Road and Vanco junction.

It was gathered that the government wanted to build a flyover at the popular Ogoja road and Vanco junction which led to the demolition.

However, traders and landlords that inhabit that area are lamenting bitterly over the level of damages and losses they have incurred over the sudden demolition, saying that they are stranded and don’t know what to do.

In an interview with some of the affected traders in the area who gave their names as Anayo and Chimezie lamented bitterly over the sudden demolition of their shops without any valid notice to that effect, saying that their goods were outside since they didn’t know where to pack them.

They further noted that no form of compensation had been given to them by the government, but only forms were submitted.

“It’s not as if we don’t like development, but this demolition affected me a lot because there was no single information nor notice given to us to vacate this place before this demolition.

“See how everybody is running helter skelter; some even sustained injury. We don’t even have a place to pack our goods. We are not happy at all.

Explosion has killed at least 12 Joint Border Patrol team at the maritime border of Bakassi Peninsula as Black Marine, a Biafran separatist militant group throws IED at the oil site in Atabong East.

According to report, the militant group left Abana to Atabong East, and on their way killed three Cameroon Gendarmes before arriving Atabong in Idabato subdivision.

Atabong youth union secretary Ndem Effiong who witnessed the incident told newsmen that the Black Marine drove with two boats shouting and asking civilians to leave the area.

Vigilante Operatives Allegedly Torture 60-Year-Old Man to Death for Selling Water Tank in Anambra

It was a tragic incident, as suspected vigilante operatives allegedly tortured a 60-year-old man to death in Anambra State.

The incident reportedly happened at Ndị Nza Ozubulu, Ekwusigo Local Government Area of the State, where the victim, simply identified as Mr. Kenneth, was subjected to a painful death, over an alleged family issue.

It was gathered that the victim reportedly sold a water tank in his family house and used the money to solve family issues, which made his younger brother to invite the vigilante group to arrest and torture him.

Mr. Kenneth, however, could no make it alive, as his arrestors tortured him to death in the process.

This is corroborated by a video currently trending on the social, which, which shows the victim as he was tied hands to back, while two men were flogging him on his bare body, both with cutlass and stick, in a setting that looks like a security office.

One of the tormentors was also seen in the video tilting Mr. Kenneth’s manhood with cutlass in the process of the torture, while he continued to groan under pains and roll on the ground like a baby. A woman, suspected to be the wife of the victim, was also heard crying in the background of the video as the victim was being tortured.

The viral video was also shared by a Nigerian activist, Harrison Gwamnishu, who took to his social media handles to call on Governor Chukwuma Soludo to intervene in the matter to get justice for Mr. Kenneth and also bring the perpetrators of such barbaric crime to book.

He wrote:

“A 60 YEAR OLD MAN, MR. KENNETH FROM TORTURED TO DEATH BY HIS OWN PEOPLE.

“Kenneth was said to have sold a water tank in his family house and used the money to solve family issues. His younger brother arrested him with Vigilante group. He was tortured for hours and died in the process. As he was being tortured, he continuously asked them “WHAT DID I DO”? They responded to him that he stole.

I wish to call Governor @ccsoludo and Anambra State Police Command to act accordingly and ensure these perpetrators don’t escape justice.

“Currently his wife and children are subjected to fear and intimidation as they have vowed to deal with them if they continue to seek for justice for the death of Mr Kenneth.

“Ndi Nza Ozubulu, Anambra State, Stop shying away from this case and protect the deceased wife and children.”

When contacted by this reporter, Izunna Okafor, the Public Relations Officer of the Anambra State Police Command, SP Ikenga Tochukwu said he had seen the video trending on the social media. He, however, said that the Command has swung into action and is making efforts to connect with the family members of the victim to have adequate information on what happened.

The PPRO also revealed that the Command has informed the Ozubulu community leadership to tell the victim’s family members to come forward with information that will help the police to carry out adequate investigation into the matter.

Protesters storm APC headquarters, demands Ganduje’s, resignation

 

A multitude of demonstrators flooded the national headquarters in Abuja, echoing calls for Ganduje’s immediate departure.

This uproar stems from Ganduje’s recent suspension by a faction of his ward executive and the bribery allegations levelled against him by the Kano state government.

Amidst chants of solidarity and a sea of banners on Wednesday advocating for Ganduje’s resignation and the restoration of the APC chairmanship to the North Central region, the protesters implored Bola Tinubu and the Secretary to the Government of the Federation, George Akume, to heed their demands and relocate party leadership to their locality.

Addressing the press in Abuja, the demonstrators, operating under the banner of Concerned Northern Central APC Stakeholders, denounced Ganduje’s prolonged tenure as a violation of the party’s zoning principles.

Muhammad Muhammad Saba, the leader of the protesters, said that, unlike the 37 APC state chairmen, the North Central region had issued a vote of no confidence in Ganduje and called for his immediate resignation.

He underscored the region’s feeling of betrayal, pointing to the appropriation of the APC national chairmanship position following the departure of Senator Abdullahi Adamu, notwithstanding the region’s substantial support for Tinubu during the 2023 presidential

This fervent display occurred merely two days after the Forum of APC State Chairmen expressed their support for Ganduje, endorsing his leadership during a visit to the party’s national secretariat.
