Sheikh Zakzaky Follower demands 100M from SSS for unlawful detention

The Counsel to Haruna Abbas, a follower of Islamic movement in Nigeria, popularly called Shiites, under the leadership of Sheikh Ibraheem Yaqoub Zakzaky has filed a notice of motion at an Abuja High Court demanding the Directorate of State Security Service (SSS) to among other things pay one hundred million Naira as damages to his Client for his unlawful detention since 21 March, 2013.

The counsel, Bello Ibrahim Esq, sought the following relief from the court: An order enforcing the Applicant’s fundamental Human rights to personal liberty which has been contravened by the Respondents by the unlawful arrest of the said Applicant on 21-03-2013.

And a declaration that the arrest of the said Applicant and perpetual detention without medical attention and access to his lawyers is a violation and contravention of the Applicants Fundamental human right to personal liberty.

The Counsel also sought for an order compelling the Respondents, their agents, servants, employees and officers and men of the SSS and any other law enforcement Agency to bring out the Applicant, forthwith and with immediate effect from their custody for the purpose of his exercise of the guaranteed Fundamental Human Rights

And an order of perpetual injunction restraining the Respondents, their Agents from violation or in any way encroaching or contravening the fundamental Human rights to personal liberty and right to a counsel of his own choice.

Bello Ibrahim Esq also prays for the court to grant an order releasing the Applicant forthwith and with immediate effect into freedom from the custody and or detention or restraint of the Respondents, their agents at anywhere or place.

And an order that the Applicant is entitled to public apology from the Respondents and compensation of the sums of  one hundred million Naira for the unlawful contravention of the Applicant’s fundamental Human Rights to personal liberty and right to a counsel of his own choice.

As at the time of filing the report no date has been fixed for the determination of the motion on notice, but the registry has said the date will be fixed soon.

Before then the solicitors of the Islamic Movement in Nigeria applied for the bail of Haruna Abbas, in a letter dated 29th March, 2013 to the Director State Security Service, Abuja.

After stating the way the Haruna Abbas was abducted by the SSS, the letter says, “Sir, we are aware that officials of the Department of State Security Service conducted a search at the residence of our Client, in Gyallesu, Zaria on the 21st day of March, 2013 and up to this moment our Client has not been released from your custody and has not been arraigned before any court of Law over any allegation or charge.”

While concluding the letter states, “Sir, if for any reason you feel that your investigation is not finished, we are then applying that you release our Client on bail. Our Client will observe and comply with the necessary bail conditios and will remain within reach whenever he is needed.

However up till now, the letter is not responded by the SSS Director.

In a related development, the SSS are holding in custody, a Kaduna born follower of Islamic movement in Nigeria Ibrahim Husain, whom they arrested in his house at Rigasa quarters of Kaduna on 27/2/2013. Neither his family or any of his relatives has been allowed by the SSS to visit him, nor has any charge been brought against him in any court of law to date.
