Kogi Election: Election Must Be Concluded, Says AGF

After so much controversy on what seems to prompt a constitutional
error on the nation’s electoral system, the Attorney General of the
Federation, Abubakar Salami (SAN) Tuesday disclosed that Independent
National Electoral Commission (INEC) will need to conclude the Kogi
gubernatorial election.
Malami, who is the Minister of Justice, said the electoral umpire
already declared last Saturday election inconclusive.
He spoke during a seminar organized by the Nigerian Law Reform
Commission in Abuja, adding that the election must be concluded.
Death of the All Progressives Congress (APC) governorship candidate,
Abubakar Audu has ignited so much controversy which analysts concluded
that the onus relies on the attorney general to proof his worth.
According to him, the APC would have to substitute its candidate for
the purpose of the supplementary elections.
“The issue is very straight forward. Fundamentally, section 33 of the
electoral Act is very clear that in case of death. The right for
substitution by a political party and a party in this case, which is
the APC has participated in the conduct of the election.
“Arising from that deduction it does not require any legal
interpretation. The interpretation is clear, APC will substitute,
which right has been sustained by Section 33 of the Electoral Act. So
be it,” he stated.
