A legal dispute over the proposed Motor Park and Railway Station situated on the disputed Ogwumabiri Land in Umuahia ,Abia state, has taken a fresh dimension as Trademore International Nigeria Limited warns the Abia State government against proceeding with the planned commissioning of the facility.
Counsel to the company, Nwoke J. Kalu, disclosed that the Abia State High Court of , in a judgment delivered on July 30, 2025, issued a perpetual injunction restraining the State government from further entry into the disputed Ogwumabiri land in Umuahia.
The lawyer stated that the state government subsequently filed an appeal against the judgment.
However, the Court of Appeal, in its decision delivered on May 6, 2026, dismissed the appeal, thereby leaving the subsisting injunction of the High Court intact.
The counsel maintained that by virtue of the dismissal of the appeal, the Abia State government no longer possesses any legal authority to enter, occupy, or carry out any activity on the disputed land, including the proposed commissioning of the Motor Park and Railway Station, allegedly constructed on the property.
Nwoke J. Kalu further argued that any attempt by the government to proceed with the commissioning exercise in defiance of the court order would amount to contempt of court and a direct affront to the rule of law.
He called on the state government to suspend all activities relating to the proposed commissioning ceremony.
The lawyer also disclosed that the Attorney General of Abia State, Ikechukwu I Uwanna, has been fm notified of the development and urged to ensure compliance with the subsisting court order by preventing any action capable of violating the injunction granted by the High Court.
The controversy surrounding the Ogwumabiri Land is expected to generate significant public and legal attention, particularly in view of the implications of the appellate court’s decision and the growing debate over compliance with judicial pronouncements by public authorities.
Sources hinted that the Abia state government hardly obey court orders made against it,adding that Governor Alex Otti is determined to commission the facility soon.
