Bauchi State Attorney To Take Over Defamation Suit Against Aide To Gov Abubakar

The Bauchi State Attorney General Barrister Ibrahim Yakubu Umar has indicated interest to take over the a suit filed before Magistrate Court 8 by Senator Ali Wakili against Personal Assistant to Governor Mohammed Abubakar on Protocol Aliyu Abdullahi Illelah for defamation of character of the said Senator.

The counsel to the Government Barrister Umar Babayo who appeared before Magistrate Ya’u  Kundak‎ ,explained that the Attorney General want to take over the case institued by Senator Ali Wakili against Aliyu Abdullahi Illelah in compliance with the section 211 of the constitution 

 

He said the section give the Attorney General the power to take over suit instituted by who ever be it public, Institution  or individual ‎to go study why he was brought before the court.

 

According to him, “The Attorney General is the only person with such power to take over any case by anybody within the confines of the sections 311 of the constitution”.

 

The complainant Senator Ali Wakili, ‎representing Bauchi South Senatorial District had earlier filed a suit against Personal Assistant to Governor Mohammed Abubakar on Protocol Aliyu Abdullahi Illelah for defamation of character.

 

The counsel to the Complainant Barrister Emmanuel Itodo Akor said “the accused was alleged to made derogatory statement against him that touches on his reputation that is why we are in court”.

 

He argued that, “the counsel to the government failed to raise reason behind his application to take over the case defending with section 311 of the constitution , so we raise  objection to their application”.

 

The president  Magistrate Ya’u Kundak has since adjourned the suit to Wednesday 12, 2017  for ruling.
