A non-governmental Organization Northern Youths Assembly has
approached the Federal High Court in Gusau seeking for an order
compelling Zamfara State government to reverse its earlier decision to
sell the state own share at the Zungeru and Mambila hydro-power
In an originating summon deposed to the court by one Barrister Ibrahim
A Jubril Esq on the 16th of July 2014 a copy which was made available
to News Men in Gusau indicates that, the plaintiff (NYA) is seeking
for seven reliefs from the Federal High Court among which includes
whether by the provision of Section 7 (1) of the 1999 Constitution as
amended, the 14 local government of Zamfara State are distinct from
the state government, and whether the state government can disposed
property either jointly or single handedly belonging to any of the
local government without their consent.
The Plaintiff is also seeking for an interpretation on whether the 19
million units of shares jointly owned by the state government and 14
local governments can be sold single handedly by the state government
without the express permission of the 14 local government Council
Other prayers included, whether the 1999 Constitution of the Federal
Republic of Nigeria recognize the status of the local government as
the third tiers of government, as well as declaration by the court
that the purported resolution of the members of the state Executive
Council sent to the members of the state house of assembly seeking for
their permission as a violation of the 1999 Nigeria’s Constitution as

summon deposed to by Zamfara State Chairman of the (NYA) , he noted
that, sales of the purported shares bought out of the deduction from
the excess crude money will amount to a robbery from the site of the
14 local governments and that the defendant is only going to use the
money to finance his campaign.
They averred that the sales of the embattle shares will lead to a
great jeopardy on the site of the state citizen especially youths some
of which bursary allowances have not been paid for the past six months
