A High Court sitting in Ibusa, Delta State, presided over by Hon. Justice H.O Akpotohwo, has issued a bench warrant for immediate arrest of a popular Asaba based land dealer, Lucky Favour Abuah, aka Bullet; his company, Henric Empire Garden Ltd., and other four accused persons in a criminal charge of forceful acquisition of land belonging to a group of landlords operating under the umbrella body of Fountain City Landlords, Asaba.
Chief Abuah, his company, Henric Empire Garden Ltd., and others were dragged to court by the Inspector General of Police, Kayode Egbetokun, over alleged breach of public peace, obtaining money by false pretenses, criminal forceful entry, dispossession of lands from its true owners, among other charges.
Chief Abuah and others were standing trial over alleged breach of public peace, obtaining money by false pretenses, criminal forceful entry, criminal dispossession of lands from their true owners etc, which are punishable under the criminal laws of Delta State, Nigeria.
When the matter came up for hearing on Thursday, November 13, 2025, Police Prosecutor, M.F Anthony, told the court that he was surprised not seeing the accused and their lawyers, despite being adequately served to appear before the court.
He reminded the court that the defendants had been playing all manner of tricks to evade justice, which he said made the court to serve them through subsistuted means; yet, they refused appear in court. He told the court that every relevant papers have been filled, and that charges have also been amended to enable the prosecution commence their case.
He cited Section 273 (1) of Delta State Criminal Justice System, and urged the court to issue a bench warrant for the arrest of the defendants.
After listening to arguments of the prosecutor, the presiding judge, Hon. Justice H.O Akpotohwo, ordered for the arrest of Chief Lucky Favour Abuah, aka Bullet; his company, Henric Empire Garden Ltd., as well as others defendants.
While adjourning the case to January 15, 2026 for pleadings, the erudite judge further ordered that the accused persons, when and wherever seen, should be apprehended and kept under police custody till the adjourned date.
Speaking after the court proceeding, a community leader in the area, who gave his name as Mike Udebunu, said that the Fountain City Landlords first bought the land with payment receipt issued to it, but that the problem started sometime in 2022, when a certain company, Henric Empire Garden Ltd., owned by one of the accused persons, Chief Lucky Favour Abuah, invaded the land with bulldozer and destroyed every property on the land, and later sold the piece of land to one PWAN PLUS Business Concerns, an estate developer owned by one Julius Ayademi.
