The National and State Assembly Election Petition Tribunal sitting in Yenagoa has ordered the Independent National Electoral Commission (INEC) to release to the Alliance for Democracy (AD) election materials needed by the Party for inspection and Analysis to enable it substantiate its claim that the House of Assembly did not hold and result rigged.
Justice C. A. Ononeze Madu gave the order Wednesday while ruling on the Election Petition numbered EPT/BY/SH/M001/2015 filed by the State House of Assembly candidate of the Alliance for Democracy (AD), Hon. Victor-Ben Eredei.
The Presiding Chairperson of the Tribunal,Justice C. A. Ononeze Madu,in her ruling on the expatriate motion moved by Applicant counsel,M.J Numa, ordered that the INEC should release polling materials including ballot papers, copies of the EC8 series,electronic print out from the Central Data Base of accredited voters obtained through the card readers used for the conduct of the election in the area.
Earlier in the motion exparte,moved by Barr.M.J Numa,counsel to the State Assembly candidate of the Alliance for Democracy (AD) in Southern Ijaw constituency 4 of the State,Hon.Victor-Ben Eredei,the Applicant sought the order of the Election Petition Tribunal to compel INEC to allow the Party inspect the election materials used for the conduct of the April 11 State Assembly election in the Constituency.
It would be recalled that the INEC had declared the PDP candidate and Speaker of the State House of Assembly,Hon. Kombowei Benson winner of the April 11 Election in the constituency 4 of the State amidst alleged non-conduct of election,violence and intimidation of the electorates.
