Ombatse Killings: Eggon Witnesses, Counsels Withdraw From The Ongoing Judicial Commission Of Inquiry

Witnesses from Eggon community along with nine [9] counsels representing the various Eggon communities in the ingoing Judicial Commission of Inquiry set- up by the Government of Nasarawa state has threatened withdrawal from the ongoing public hearing going at High court 2 – if the commission continues to exhibit bias against the Eggon people.

The position of the two parties – witnesses and counsels – was made known at a press briefing held at Nurses House along Jos road – in a statement signed by Chief Ayas Bako (Esq) and Aliyu Anzewu [as counsels] representing Joshua Daudu, District head of Bassa Zarangi in Kokona Local Government.

The statement reads that the aggrieved parties must take steps to nip the selective justice exhibited by the chairman of the commission which is tantamount to jeopardizing the process. According to the statement, “It is a breach of the commission’s rules chapter 7(1) chapter 7 (2) and chapter 7 of the proceeding”, – and for this reason are withdrawing on the grounds that –

  1. Eggon counsels representing interested parties at the commission have been whimsically refused the right of cross-examination of presenters of memoranda despite the provisions contained in chapter 7.1,7.2,7.3 of the rules of the proceedings at the commission.
  2. That during the presentation of the first memorandum submitted by Ipusu community of Kadarko in Keana Local Government, saying the right was violated during subsequent memorandum.
  3. That on the 24th July,2013,Ovye John esq counsel representing Eggon communities in Barikin Abdullahi (BAD) and Randa was also disallowed to cross-examine Bar.Musa Aloko representing Migili traditional council.
  4. That on thr 25th of July 2014 at the Emirs palace Lafia Chief Bako Ayas counsel to representing Joshua Dauda the district head of Bassa Zarangi district of Kokona Local Government Area.
  5. That on the 26 July 2013,Christopher Aku representing Hon.Nuhu on behalf Iggah community applied to cross-examine Hon.Mohammed Adagbo who presented a memorandum of Alago people of Anah (Burum-Burum) in Doma Local Government, The commission refused him the opportunity to do so, breaching the fundamental principle of fair hearing.
  6. That GE Affiku esq was refused an oppurtunity to cross-examine the presenter of memoramdum from Burum-Burum.
  7. That on 30 July 2013 the commission refused the application of Aku christopher esq representing Hon.Nuhu Kagbu but allow Bar.Ubandoma to make an oral application for addendum on behalf of this which was granted.
  8. That the chairman does not understand Hausa Language and he has refused to avail himself the use of commission’s interpreter at some crucial points preferring instead to depend on the misinterpretation of other members who are Hausa/Fulani particularly Bar.Muntacir Mohammed.

His interpretation of testimonies of witnesses in those circumstances can hardly be devoid of interest, having regard to the well documented conflicts between Fulani herdsmen and several communities including Eggon.

That to worsen the breach of the fundamental principle of fair hearing ,The commission chairman ordered all counsels to file their respective memorandum of appearance, The nine counsels to Eggon nation also claimed discrimination among Eggon fulcrum, Adding that some memos were made sacred and not accessible to the other parties.

They listed some of the sacred memorandums to include the one filed in by Nasarawa State Government, The Nigeria Police and the Department of State Security.

While speaking – an elderly counsel, Bar Bako said the commission lacks justification, saying the commission was used to achieve a predetermined target, He further stated that “litigation is not a game of chase”.
Also while contributing, The legal Adviser to Ombatse,Bar Zachariah Alumaga said they will take the next step if the chairman of the commission, Rtd Justice,Joseph Fola Gbadeyan does not adjust his actionsby applying the tenet of the Judicial system.
