We are on notice of the contemptuous antics of Chief Victor Umeh and Alhaji Sani Shinkafi former National Chairman and Secretary respectively, of our great party. The duo has in the last couple of weeks been sending spurious and tendentious petitions to the Independent National Electoral Commission (INEC) Chief Justice of Nigeria and The Police. In each of these instances, Chief Umeh and his partner Alhaji Shinkafi clearly endorsed the documents as National Chairman and National Secretary respectively. In fact the letter dated 21st February, 2013, titled:”Unlawful dissident activies and factionalisation of APGA”, was signed for APGA by Chief Victor Umeh as National Chairman and Alhaji Sani Shinkafi National Secretary.

In Suit No. E/270/2012 between Okuli Jude Ejike and Sir Victor C. Umeh. The Honourable Justice I.A. Umezulike, Chief judge of Enugu State stated in page 38 last paragraph:

What I have been trying to say, perhaps in too many words, is that the convention of 10th February, 2011 of APGA was unconstitutional, null and void. In strict law, no national officer of the party was validly elected at that convention. The conclusion of law that follows the above analysis is that the tenure of the defendant as the National Chairman of APGA came to a legitimate end on the 2nd day of December, 2010. And in law, he has since 2nd December, 2010 been out of office as the National Chairman of APGA having not been re-elected in accordance with the provisions of Article 18 of the Constitution of APGA.

At page 40 item 5, Hon. Jusctice Umezulike stated:

”That the defendant be and is hereby restraint from parading himself as the National Chairman of All Progressives Grand Alliance.

Chief Umeh and his ally however in total contempt and disregard of the clear pronouncement of the court have engaged in this crass irresponsibility and total disregard for the rule of law. Our interim administration has made the 3 Rs – rapprochement, reconciliation and re-integration, the focal point to restore peace to the party. Unfortunately, Umeh and his ally have no intention of acceding to olive branch.

We therefore serve notice to the general public and particularly to the duo that we have instructed our solicitors to immediately commence contempt proceedings against the duo as to send them to prison where they rightfully belong.

DR. SAGIR MAIDOYA

INTERIM NATIONAL SECRETARY, APGA
